1 AN ACT
2 To enact Code of Criminal Procedure Article 880(F) and (G), relative to credit for time
3 served in actual custody; to provide for limitations; and to provide for related
4 matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. Code of Criminal Procedure Article 880(F) and (G) are hereby enacted
7 to read as follows:
8 Art. 880. Credit for prior custody; limitations
9 * * *
10 F. A defendant shall not receive overlapping jail credit when consecutive
11 sentences are imposed for multiple counts or charges, regardless if the sentence
12 imposed is subsequently corrected pursuant to Article 881.5. Credit for time spent
13 in actual custody shall be applied to only one of the consecutive sentences imposed.
14 G. Any overlapping jail credit that is awarded in violation of this Article is
15 null, void, and of no effect.
