HOUSE BILL NO. 20

RETIREMENT/TEACHERS: Provides relative to the reemployment of retirees in the
Teachers' Retirement System of Louisiana
1 AN ACT
2 To amend and reenact R.S. 11:710.1(A)(1)(a) and (c) and (C)(1), relative to the Teachers'
3 Retirement System of Louisiana; to provide for the reemployment of retirees; to
4 provide for compensation during reemployment; to provide for costs; and to provide
5 for related matters.
6 Notice of intention to introduce this Act has been published
7 as provided by Article X, Section 29(C) of the Constitution
8 of Louisiana.
9 Be it enacted by the Legislature of Louisiana:
10 Section 1. R.S. 11:710.1(A)(1)(a) and (c) and (C)(1) are hereby amended and
11 reenacted to read as follows:
12 §710.1. Employment of retirees who retired on or after July 1, 2020
13 A. Except as otherwise provided in this Section, any retiree who returns to
14 active service with an employer covered by the provisions of this Chapter and who
15 retired on or after July 1, 2020, shall for that period of employment choose one of the
16 following irrevocable options, which shall be made in writing and filed with the
17 appropriate officer of the employer:
18 (1) Option 1. (a) Any retiree may be employed in any position covered by
19 this system during any fiscal year, provided that his earnings in such employment do
20 not exceed twenty-five one hundred percent of his final average compensation during

1 any fiscal year. If actual earnings exceed this amount in any fiscal year, the benefits
2 payable to the retiree shall be reduced by the amount in excess of twenty-five one
3 hundred percent of his final average compensation.

5 (c) Any retiree employed in a full-time position exercising Option 1 as
6 provided in this Paragraph may prospectively exercise Option 2 any time prior to or
7 after reaching twenty-five one hundred percent of his final average compensation.
8 In such case, all employee contributions made in accordance with this Paragraph
9 prior to the exercise of Option 2 shall be refunded at that time. If a retiree has earned
10 in excess of twenty-five one hundred percent of his final average compensation prior
11 to an election made pursuant to this Subparagraph, the employee contributions
12 eligible for refund or the benefits payable to the retiree shall be reduced by said
13 amount.

15 C.(1) Any retiree who returns to active service covered by the provisions of
16 this Chapter within the twelve-month three-month period immediately following the
17 effective date of such retirement shall have his retirement benefits suspended for the
18 duration of such active service or the lapse of twelve three months from the effective
19 date of his retirement, whichever occurs first, even if such service is based on
20 employment by contract or corporate contract.

22 Section 2. The cost of this Act, if any, shall be funded with additional employer
23 contributions in compliance with Article X, Section 29(F) of the Constitution of Louisiana.

Present law authorizes retirees of the Teachers' Retirement System of La. to be reemployed
in a position covered by the system without a reduction of his retirement benefit if his
earnings from such employment during a fiscal year do not exceed 25% of his final average
compensation. If his earnings exceed this limit, present law authorizes him to choose a
benefit reduction or to become a member of the system again and earn a supplemental
benefit.
Proposed law retains present law except to increase the earnings limit to 100% of the
retiree's final average compensation.
Present law provides that a retiree who returns to active service within 12 months of his
retirement has his benefit suspended for the duration of reemployment or a lapse of 12
months, whichever occurs first.
Proposed law shortens the suspension duration to three months. Otherwise retains present
law.
Proposed law requires that any cost of proposed law be funded with additional employer
contributions in compliance with present constitution (Art. X, Sec. 29(F)).
