SEWERAGE: Authorizes a person to install an individual sewer treatment system in certain
circumstances
1 AN ACT
2 To enact R.S. 40:1281.27, relative to sewerage systems; to provide for the installation of
3 individual sewerage systems in certain circumstances; to provide for definitions; to
4 provide for an effective date; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 40:1281.27 is hereby enacted to read as follows:
7 §1281.27. Authorization to install an individual sewerage system
8 A. A person may install and operate an individual sewerage system and is
9 not required to connect to a community sewerage system unless the community
10 sewerage system is owned by a city, parish, or other municipality of this state or
11 local ordinances require connection to a community sewerage system.
12 B. For the purposes of this Section:
13 (1) "Community sewerage system" means any sewerage system which serves
14 multiple connections and may consist of systems to collect, transport, and treat
15 sewerage.
16 (2) "Individual sewerage system" means a collection of systems to collect,
17 transport, and treat sewerage located on the property where the sewerage originates.
18 Section 2. This Act shall become effective upon signature by the governor or, if not
19 signed by the governor, upon expiration of the time for bills to become law without signature
20 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
21 vetoed by the governor and subsequently approved by the legislature, this Act shall become
22 effective on the day following such approval.

Abstract: Authorizes a person to install an individual sewerage system despite the presence
of community sewerage system unless the community sewerage system is owned by
a municipality of this state.
Proposed law provides that a person shall not be required to connect to community sewerage
system and may install and operate an individual sewerage system unless the community
sewerage system is owned by a municipality of this state or a local ordinances require
connection to a community sewerage system.
Proposed law provides for definitions.
Effective upon signature of governor or lapse of time for gubernatorial action.
