HOSPITALS: Provides for the duties of a hospital director
1 AN ACT
2 To amend and reenact R.S. 46:1057, relative to hospital service districts; to provide for the
3 duties and responsibilities of a hospital director; to provide for the authority of the
4 hospital service district commission; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 46:1057 is hereby amended and reenacted to read as follows:
7 §1057. Duties of director
8 A. In addition to the duties imposed upon him by other provisions of this
9 Chapter, it shall be the duty of the director to do all of the following:
10 (1) To attend all meetings of the commission and to act as secretary and keep
11 the official minutes of the proceedings.
12 (2) With the consent of the commissioners, and To, subject to such
13 budgetary limitations and any civil service laws in effect, the director shall have
14 power to establish positions and to make appointments thereto; to establish rates of
15 pay; to abolish positions; to transfer duties among positions; to assign duties to,
16 direct and control the work of, and transfer, promote, demote, remove and remove,
17 or otherwise change the status of employees of the district.
18 (3) To make and publish such reports regarding the work of the district as
19 may be required by law, or which he may be directed to make by the commission.

1 (4) To see that the policies relating to the conduct of the affairs of the district
2 which have been established by the commission are carried out.
3 (5) To cooperate with the medical staff in the performance of the policies
4 which it may establish.
5 (6) To prepare an annual budget for approval by the commission and the
6 police jury.
7 (7) To recommend to the commission the scale of rates to be charged for
8 services rendered by the district.
9 (8) To provide for adequate medical records and reports.
10 (9) To control and direct all business affairs of the district. By way of
11 extension and not of limitation, these duties shall include the keeping of the accounts
12 of the district, making necessary purchase of equipment, supplies, and materials, and
13 making major and minor repairs to physical facilities.
14 (10) To receive and receipt for and keep a correct accounting of all gifts,
15 bequests, grants-in-aid, and other revenues received by the district and, with the
16 consent of the commission, to expend the proceeds of all such gifts, bequests, grants-
17 in-aid, and other revenues for the purpose purposes designated in this Chapter and
18 subject to any conditions that may be imposed in any act of donation or any law
19 providing grants-in-aid or other revenues for such purpose.
20 (11) To perform any other duties and functions which he or the commission
21 consider necessary or desirable to carry out the purposes of this Chapter.
22 (B) Notwithstanding any other law to the contrary, the director has exclusive
23 control over all executive functions and general operations of the district.

Present law provides that with the consent of a hospital service district commission and
subject to budget limitations and any civil service laws, the hospital director has the
following duties:
(1) To establish positions and to make appointments.
(2) To establish rates of pay.
(3) To abolish positions.
(4) To transfer duties among positions.
(5) To assign duties to, direct and control the work of, and transfer, promote,
demote, remove, or otherwise change the status of employees of the district.
Present law provides that a hospital service district commission has the authority to conduct
hearings and pass upon complaints by or against any officer or employee of the district.
Proposed law modifies present law clarifying that a hospital director has exclusive control
over all executive functions and general operations of the district.
