CIVIL/DONATIONS: Provides relative to acts of donation of motor vehicles
1 AN ACT
2 To amend and reenact Civil Code Article 1543, relative to manual gifts; to provide relative
3 to the donation of motor vehicles; to limit the persons and entities eligible to receive
4 donations of motor vehicles; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. Civil Code Article 1543 is hereby amended and reenacted to read as
7 follows:
8 Art. 1543. Manual gift
9 A. The Except for the donation of a motor vehicle, the donation inter vivos
10 of a corporeal movable may also be made by delivery of the thing to the donee
11 without any other formality.
12 B. The donation inter vivos of a motor vehicle shall be made only to the
13 following:
14 (1) Ascendants, descendants, or collaterals of the donor.
15 (2) Charitable organizations.
16 (3) Post-secondary institutions of higher education.

Abstract: Limits who can be a donee of a donated motor vehicle.
Present law authorizes the donation inter vivos of a corporeal movable to be made to any
donee by delivery of the thing without any other formality.
Proposed law modifies present law to provide that the donation inter vivos of a motor
vehicle shall only be available to the following:
(1) Ascendants, descendants, and collaterals of the donor.
(2) Charitable organizations.
(3) Post-secondary institutions of higher education.
