1 AN ACT
2 To amend and reenact R.S. 14:34.9(I) and 35.3(I), relative to battery of a dating partner and
3 domestic abuse battery; to provide for penalties when a child is present; and to
4 provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 14:34.9(I) and 35.3(I) are hereby amended and reenacted to read as
7 follows:
8 §34.9. Battery of a dating partner

10 I. This Subsection shall be cited as the "Dating Partner Abuse Child
11 Endangerment Law". Notwithstanding any provision of law to the contrary, when
12 the state proves, in addition to the elements of the crime as set forth in Subsection
13 A of this Section, that a minor child thirteen years of age or younger was present at
14 the residence or any other scene at the time of the commission of the offense, the
15 offender, in addition to any other penalties imposed pursuant to this Section, shall
16 be imprisoned at hard labor for not more than three years. as follows:
17 (1) For a first offense, not less than one year nor more than three years at
18 hard labor.

20 than six years at hard labor.
