TOBACCO/TOBACCO PRODUCTS: Prohibits the sale of vapor products near schools
1 AN ACT
2 To enact R.S. 26:911(A)(7), relative to vapor products; to prohibit certain acts relative to the
3 sale of vapor products within three hundred feet of schools; and to provide for related
4 matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 26:911(A)(7) is hereby enacted to read as follows:
7 §911. Acts prohibited
8 A. No person, agent, associate, employee, representative, or servant of any
9 person shall permit any of the following acts to be done on or about any premises
10 which sells or offers for sale tobacco products, alternative nicotine products, or vapor
11 products:

13 (7)(a) When prohibited by municipal or parish ordinance, the sale, offer for
14 sale, storing, or maintaining of stock of vapor products on any licensed premises
15 situated within three hundred feet or less of a school as defined by R.S.
16 17:405(A)(2).
17 (b) In municipalities and in unincorporated areas which are divided into
18 subdivisions with streets, blocks, and sidewalks, subject to the adoption of the
19 alternate method of measurement as provided for in Subparagraph (c) of this
20 Paragraph, the distance of three hundred feet shall be measured as a person walks
21 using the sidewalk from the nearest point of the property line of the school to the
22 nearest point of the licensed premises. The provisions of this Paragraph shall apply
23 to any licensed premises upon the adoption of the municipal or parish ordinance.

1 (c) A municipality or parish may adopt an ordinance establishing an alternate
2 method of measurement of the three hundred foot limitation by measuring in a
3 straight line from the nearest point of the property line of the school to the nearest
4 point of the licensed premises. Such alternate method of measurement applies only
5 prospectively to any new permit issued on or after the date the ordinance establishing
6 the alternate measurement has been adopted.

Abstract: Prohibits the sale of vapor products near a school.
Present law defines "vapor product" as any non-combustible product containing nicotine or
other substances that employ a heating element, power source, electronic circuit, or other
electronic, chemical or mechanical means, regardless of shape or size, that can be used to
produce vapor from nicotine in a solution or other form.
Present law further provides that "vapor product" includes any electronic cigarette, electronic
cigar, electronic cigarillo, electronic pipe, or similar product or device and any vapor
cartridge or other container of nicotine in a solution or other form that is intended to be used
with or in an electronic cigarette, electronic cigar, electronic cigarillo, electronic pipe, or
similar product or device.
Present law provides relative to retail dealer permits and the renewal of retail dealer permits
for the sale of vapor products.
Proposed law retains present law and prohibits the sale, offer for sale, storage, or
maintenance of stock of vapor products on a premises situated within 300 feet of a school
when prohibited by a municipal or parish ordinance.
Proposed law provides that in municipalities and unincorporated areas divided into
subdivisions, the measurement of 300 feet is to be measured as a person walks using the
sidewalk from the nearest point of the property line of the school to the nearest point of the
premises to be licensed.
Proposed law authorizes the municipality or parish to establish an alternate method of
measurement of the 300 foot limitation by measuring in a straight line from the nearest point
of the property line of the school to the nearest point of the premises to be licensed.
Proposed law provides that the alternative method of measurement applies only
