1 AN ACT
2 To amend and reenact R.S. 22:1476(A)(2), relative to the Municipal Fire and Police Civil
3 Service Operating Dedicated Fund Account; to provide for the deposit of a certain
4 portion of insurance premium assessments into the Municipal Fire and Police Civil
5 Service Operating Dedicated Fund Account; to provide for applicability; to provide
6 for an effective date; and to provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. R.S. 22:1476(A)(2) is hereby amended and reenacted to read as follows:
9 §1476. Assessments against insurers; dedications

12 (2) In every year, In Fiscal Year 2027-2028 and 2028-2029, an amount equal
13 to three hundredths of one percent and in Fiscal Year 2029-2030 and each fiscal year
14 thereafter, an amount equal to two three and one-half hundredths of one percent of
15 the direct gross premiums received in the state, by insurers doing business in this
16 state and subject to this Subpart, less returned premiums shall be deposited by the
17 commissioner of insurance with the state treasurer to be credited to a special agency
18 account, created in the state treasury entitled the Municipal Fire and Police Civil
19 Service Operating Dedicated Fund Account, to be known as the "account". Subject

1 to an annual appropriation by the legislature pursuant to the provisions of R.S.
2 33:2480 and 2540, monies in the account shall be used solely to support the
3 operations of the office of state examiner, Municipal Fire and Police Civil Service.
4 Monies in the account shall be invested by the treasurer in the same manner as
5 monies in the state general fund and interest earned on investment of these monies
6 shall be credited to the state general fund. All unexpended and unencumbered
7 monies in the account at the end of the fiscal year shall remain in the account.
8 Funding deposited into the account shall be considered fees and self-generated
9 revenues and shall be available for annual appropriations by the legislature.

11 Section 2. This Act shall become effective on July 1, 2026.

Abstract: Increases the dedication of a certain portion of insurance premium assessments
into the Municipal Fire and Police Civil Service Operating Dedicated Fund Account.
Present law requires all insurers in Louisiana to pay an assessment on gross direct premiums
received by an insurer in the state in the preceding year. No assessment shall exceed 1% of
the gross premiums.
Present law requires 0.025 of 1% of the gross direct premiums received in the state to be
deposited into the Municipal Fire and Police Civil Service Operating Dedicated Fund
Account. Monies in the fund are used to support the operations of the office of the state
examiner, Municipal Fire and Police Civil Service.
Proposed law increases the deposit from 0.025 of 1% to 0.030 of 1% of gross direct
premiums for FY 2027-2028 and 2028-2029. Increases the deposit from 0.030 of 1% to
0.035 of 1% in FY 2029-2030 and each fiscal year thereafter.
Effective July 1, 2026.
