STUDENT/DISCIPLINE: Prohibits the assignment of prekindergarten or kindergarten
students to an alternative school unless suspended or expelled for certain infractions
1 AN ACT
2 To enact R.S. 17:100.5(E), relative to student discipline; to prohibit students in certain
3 grades from being assigned to an alternative school; to provide exceptions; and to
4 provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 17:100.5(E) is hereby enacted to read as follows:
7 §100.5. Alternative schools; establishment by local boards

9 E. Notwithstanding any provision of law to the contrary, a student who is
10 enrolled in prekindergarten or kindergarten shall not be assigned to an alternative
11 school unless the student is either suspended or expelled for an infraction involving
12 drugs, weapons, assault, or battery as provided in R.S. 17:416.

alternative school unless suspended or expelled for certain infractions.
Present law allows school boards to establish alternative schools for students who are
disruptive. Also provides for the assignment of students to alternative schools who are
suspended or expelled for certain infractions, including those related to drugs, weapons,

assault, or battery. Proposed law retains present law and prohibits the assignment of a
