CHILDREN/LEGITIMATION: Provides relative to the presumption of parentage
1 AN ACT
2 To amend and reenact Civil Code Article 185, relative to the presumption of parentage; to
3 reduce the time line for the presumption of marriage; and to provide for related
4 matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. Civil Code Article 185 is hereby amended and reenacted to read as
7 follows:
8 Art. 185. Presumption of paternity of husband
9 The husband of the mother is presumed to be the father of a child born during
10 the marriage or within three hundred ninety days from the date of the termination of
11 the marriage.

Abstract: Reduces the time line for the presumption of paternity.
Present law (C.C. Art. 185) provides that the husband of the mother is presumed to be the
father of a child born during the marriage or within 300 days from the date of the termination
of the marriage.
Proposed law changes the time line in present law from 300 days to 90 days from the date
of the termination of the marriage.
