HOUSE BILL NO. 333

CORRECTIONS/PRISONERS: Provides relative to the housing of inmates committed to
the custody of the Department of Public Safety and Corrections
1 AN ACT
2 To amend and reenact R.S. 15:824(A) and to enact R.S. 15:824(E), relative to prisoners; to
3 provide relative to housing of inmates committed to the custody of the Department
4 of Public Safety and Corrections; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 15:824(A) is hereby amended and reenacted and R.S. 15:824(E) is
7 hereby enacted to read as follows:
8 §824. Commitment of persons to the Department of Public Safety and Corrections
9 A. Notwithstanding any provision of law to the contrary In accordance with
10 Subsection E of this Section, any individual subject to confinement in a state adult
11 penal or correctional institution shall be committed to the Department of Public
12 Safety and Corrections and not to any particular institution within the jurisdiction of
13 the department. The secretary of the department may transfer an inmate from one
14 such facility to another, insofar as the transfer is consistent with the commitment and
15 in accordance with treatment, training, and security needs established by the
16 department.

18 E. Notwithstanding any provision of law to the contrary, the department shall
19 not house an inmate more than thirty miles outside either of the following locations:

1 (1) The parish where the criminal offense occurred or where the inmate was
2 convicted.
3 (2) The parish where the residence or domicile of the inmate is located.

Abstract: Provide relative to housing of inmates committed to the custody of the Dept. of
Public Safety and Corrections (DPS&C).
Present law provides for the commitment of an individual who is subject to confinement in
a state adult penal or correctional institution to the DPS&C.
Proposed law retains present law.
Proposed law prohibits the DPS&C from housing an inmate more than 30 miles outside
either of the following locations:
(1) The parish where the criminal offense occurred or where the inmate was convicted.
(2) The parish where the residence or domicile of the inmate is located.
