HOUSE BILL NO. 36

1 AN ACT
2 To amend and reenact R.S. 15:1109.1(A)(1) through (8) and to enact R.S. 15:1109.1(C) and
3 1109.5(D) and (E), relative to the Acadiana Regional Juvenile Justice District; to
4 provide for appointment to the board of commissioners; to provide for the power to
5 levy taxes, incur debt, and issue bonds; to provide for vacancies; to provide for an
6 effective date; and to provide for related matters.
7 Notice of intention to introduce this Act has been published
8 as provided by Article III, Section 13 of the Constitution of
9 Louisiana.
10 Be it enacted by the Legislature of Louisiana:
11 Section 1. R.S. 15:1109.1(A)(1) through (8) are hereby amended and reenacted and
12 R.S. 15:1109.1(C) and 1109.5(D) and (E) are hereby enacted to read as follows:
13 §1109.1. Board of commissioners; appointments; terms
14 A. The Acadiana Regional Juvenile Justice District Commission is hereby
15 created to control, administer, and manage the affairs of the district. The commission
16 shall be composed of a board of eleven commissioners who shall be appointed as
17 follows:
18 (1) One commissioner, who shall be a qualified elector domiciled and
19 residing within Acadia Parish, shall be jointly appointed by the chief judge and
20 district attorney for the Fifteenth Judicial District, and the sheriff of Acadia Parish,
21 and the police jury president of a parish having a population of more than fifty seven
22 thousand five hundred and less than fifty eight thousand persons according to the
23 most recent federal decennial census, for an initial term of four years.

1 (2) One commissioner, who shall be a qualified elector domiciled and
2 residing in Allen Parish, shall be jointly appointed by the chief judge and district
3 attorney for the Thirty-Third Judicial District, and the sheriff of Allen Parish, and the
4 police jury president of a parish having a population of more than twenty two
5 thousand five hundred and less than twenty three thousand persons according to the
6 most recent federal decennial census, for an initial term of four years.
7 (3) One commissioner, who shall be a qualified elector domiciled and
8 residing within Evangeline Parish, shall be jointly appointed by the chief judge and
9 district attorney for the Thirteenth Judicial District, and the sheriff of Evangeline
10 Parish, and the police jury president of a parish having a population of more than
11 thirty two thousand three hundred and less than thirty three thousand persons
12 according to the most recent federal decennial census, for an initial term of four
13 years.
14 (4) One commissioner, who shall be a qualified elector domiciled and
15 residing within Iberia Parish, shall be jointly appointed by the chief judge and district
16 attorney of the Sixteenth Judicial District, and the sheriff of Iberia Parish, and the
17 president of a parish having a population of more than sixty nine thousand and less
18 than seventy thousand persons according to the most recent federal decennial census,
19 for an initial term of four years.
20 (5) One commissioner, who shall be a qualified elector domiciled and
21 residing in Jefferson Davis Parish, shall be jointly appointed by the chief judge and
22 district attorney for the Thirty-First Judicial District, and the sheriff of Jefferson
23 Davis Parish, and the police jury president of a parish having a population of more
24 than thirty two thousand two hundred and less than thirty two thousand three
25 hundred persons according to the most recent federal decennial census, for an initial
26 term of four years.
27 (6) One commissioner, who shall be a qualified elector domiciled and
28 residing in St. Landry Parish, shall be jointly appointed by the chief judge and
29 district attorney for the Twenty-Seventh Judicial District, and the sheriff of St.
30 Landry Parish, and the president of a parish having a population of more than eighty

1 two thousand and less than eighty three thousand persons according to the most
2 recent federal decennial census, for an initial term of four years.
3 (7) One commissioner, who shall be a qualified elector domiciled and
4 residing within St. Martin Parish, shall be jointly appointed by the chief judge and
5 district attorney for the Sixteenth Judicial District, and the sheriff of St. Martin
6 Parish, and the police jury president of a parish having a population of more than
7 fifty one thousand five hundred and less than fifty two thousand persons according
8 to the most recent federal decennial census, for an initial term of four years.
9 (8) One commissioner, who shall be a qualified elector domiciled and
10 residing in St. Mary Parish, shall be jointly appointed by the chief judge and district
11 attorney for the Sixteenth Judicial District, and the sheriff of St. Mary Parish, and the
12 police jury president of a parish having a population of more than forty nine
13 thousand and less than fifty thousand persons according to the most recent federal
14 decennial census, for an initial term of four years.

16 C. Failure of appointed members to attend two consecutive meetings shall
17 be cause for termination from the commission and the position shall be deemed
18 vacant by notifying the appropriate appointing party. The appointing authority shall
19 have ninety days to fill the vacancy.

23 D. The board shall provide written notice, at least thirty days prior to the date
24 of any meeting, at which the board may consider and take action on a matter set forth
25 in this Section, and such written notice shall be provided to the governing authority
26 of each of the parishes that comprise the Acadiana Regional Juvenile Justice District.
27 E. Notwithstanding the provisions of R.S. 15:1109.3(C), any action or
28 resolution authorizing the levy of a tax pursuant to this Section shall be required to
29 be approved by every member of the board and shall be subsequently approved, by
30 written resolution or other authorized form, by the governing authority of each of the

1 parishes that comprise the Acadiana Regional Juvenile Justice District, prior to any
2 such measure being placed on the ballot.
3 Section 2. This Act shall become effective upon signature by the governor or, if not
4 signed by the governor, upon expiration of the time for bills to become law without signature
5 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
6 vetoed by the governor and subsequently approved by the legislature, this Act shall become
7 effective on the day following such approval.
