1 AN ACT
2 To amend and reenact R.S. 37:2164(A) and to enact R.S. 37:2159.1(9), relative to contractor
3 services; to prohibit certain acts for persons performing contracting services; to
4 provide for penalties; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 37:2164(A) is hereby amended and reenacted and R.S. 37:2159.1(9)
7 is hereby enacted to read as follows:
8 §2159.1. Contracting; prohibited acts; property insurance
9 The following acts are prohibited by persons performing contracting services:

11 (9) Unsolicited homeowner contact including but not limited to door
12 hangers, business cards, magnets, flyers, pamphlets, text messages, emails, or any
13 unscheduled sales visits.

15 §2164. Violations; civil penalty; jurisdiction
16 A. Any person who violates any provision of this Chapter shall, after notice
17 and a hearing, be liable to the board for a fine of up to ten twenty percent of the total
18 contract or the value of the work bid or being performed for which there is a
19 violation. In addition to the fine, the board may impose administrative costs and
20 attorney fees for each offense. In determining the amount of the administrative

1 penalty, the board or residential subcommittee shall consider the circumstances and
2 seriousness of the violation, cooperation on the part of the contractor, and the history
3 of previous violations.

Abstract: Provides relative to contractor services.
Present law provides for acts that are prohibited for persons performing contracting services.
Proposed law adds the prohibition of unsolicited homeowner contact including but not
limited to door hangers, business cards, magnets, flyers, pamphlets, text messages, emails,
or any unscheduled sales visits.
Present law provides that any person who violates any provision of present law shall, after
notice and a hearing, be liable to the board for a fine of up to 10% of the total contract or the
value of the work bid or being performed for which there is a violation.
Proposed law increases the fine to up to 20%.
