CIVIL/PROCEDURE: Provides for the prescriptive period for certain actions for abuse of
a minor
1 AN ACT
2 To amend and reenact Section 2 of Act No. 481 of the 2024 Regular Session of the
3 Legislature of Louisiana, relative to prescription; to provide relative to the
4 prescriptive period for certain civil actions against a person for certain acts
5 committed against a minor; to provide relative to implementation; to provide for an
6 effective date; and to provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. Section 2 of Act No. 481 of the 2024 Regular Session of the Legislature
9 of Louisiana is hereby amended and reenacted to read as follows:

11 Section 2. Any person whose cause of action related to sexual abuse of a
12 minor was barred by liberative prescription shall be permitted to file an action under
13 R.S. 9:2800.9 on or before June 14, 2027 2029. It is the express intent of the
14 legislature to revive until June 14, 2027 2029, any cause of action related to sexual
15 abuse of a minor that previously prescribed under any Louisiana prescriptive period.

Abstract: Provides for the revival of claims for abuse of a minor and extends the timeframe
to file an action.
Present law authorizes any person whose cause of action related to sex abuse of a minor was
previously barred by liberative prescription to file an action on or before June 14, 2027.
Present law provides that it is the express intent of the legislature to revive until June 14,
2027, any cause of action related to sexual abuse of a minor that previously prescribed under
any La. prescriptive period.
Proposed law retains present law, but extends the deadline to file an action from June 14,
2027, to June 14, 2029.
