PROPERTY/EXPROPRIATION: Provides relative to expropriation
1 AN ACT
2 To amend and reenact R.S. 19:12, relative to expropriation; to assign court costs to an
3 expropriating authority; and to provide for related matters.
4 Be it enacted by the Legislature of Louisiana:
5 Section 1. R.S. 19:12 is hereby amended and reenacted to read as follows:
6 §12. Tender of true value refused; costs Court costs; expropriating authority
7 If the highest amount offered prior to the filing of the expropriation suit is
8 equal to or more than the final award, the court may, in its discretion, order the
9 defendant to pay all or a portion of the costs of the expropriation proceedings. All
10 of the court costs actually incurred because of the expropriation proceeding shall be
11 paid by the expropriating authority.

Abstract: Requires expropriating authorities to pay court costs of expropriation
proceedings.
Present law (R.S. 19:12) provides that if the highest amount of compensation offered prior
to the expropriation suit is equal to or more than the final award, the court may order the
property owner to pay all or a portion of the costs of the expropriation proceedings.
Proposed law deletes present law and assigns court costs actually incurred to expropriating
authorities.
