1 AN ACT
2 To amend and reenact R.S. 32:232(introductory paragraph) and 1741(K) and to enact R.S.
3 32:232(3)(h), relative to traffic control signals; to provide relative to traffic
4 violations; to provide relative to penalties for violations when no injury occurs; to
5 provide for immobilization of vehicles for traffic violations; and to provide for
6 related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. R.S. 32:232(introductory paragraph) and 1741(K) are hereby amended
9 and reenacted and R.S. 32:232(3)(h) is hereby enacted to read as follows:
10 §232. Traffic-control signals
11 Whenever traffic is controlled by traffic-control signals exhibiting different
12 colored lights, or colored lighted arrows, successively one at a time or in
13 combination, only the colors green, red, and yellow shall be used, except for special
14 pedestrian signals carrying a word legend, and said. The lights shall indicate and
15 apply to drivers of vehicles and pedestrians as follows:

19 (h) If the violation involves entering a shoulder or turn lane to overtake a
20 vehicle that is stopped or slowing to a stop at a red indication, but does not result in
21 an injury, the offender shall be fined two hundred fifty dollars.

1 K.(1) Nothing in this Chapter shall be construed to prohibit any parish or
2 municipality from enacting ordinances that impose more restrictive requirements or
3 regulations than those provided in this Chapter.
4 (2) Notwithstanding any provision of law to the contrary, no person shall
5 immobilize or boot a motor vehicle for failure to pay a citation issued through an
6 automated traffic enforcement system for a red-light traffic violation unless the
7 vehicle owner has first been afforded an administrative hearing relative to the traffic
8 citation. The provisions of this Paragraph shall not apply to Orleans Parish.
