FLOODING/CONTROL: Prohibits expropriation by the board of commissioners of the
Amite River Basin Drainage and Water Conservation District in East Feliciana and
St. Helena Parishes
1 AN ACT
2 To amend and reenact R.S. 38:3306(F), relative to expropriation authority of the Amite
3 River Basin Drainage and Water Conservation District board of commissioners; to
4 prohibit expropriation by the board within the parishes of East Feliciana and St.
5 Helena; and to provide for related matters.
6 Notice of intention to introduce this Act has been published
7 as provided by Article III, Section 13 of the Constitution of
8 Louisiana.
9 Be it enacted by the Legislature of Louisiana:
10 Section 1. R.S. 38:3306(F) is hereby amended and reenacted to read as follows:
11 §3306. General powers and duties of the board

13 F. The board may expropriate property subject to and in accordance with
14 R.S. 48:441-460 R.S. 48:441 through 460, where applicable; however, the board
15 shall not expropriate property within the parishes of East Feliciana and St. Helena.
16 The owner of residential property or commercial property, including homes,
17 businesses, barns, outbuildings and churches, shall be paid the replacement cost of
18 any such property expropriated by the board.

Present law authorizes the board of the Amite River Basin Drainage and Water Conservation
District to expropriate property and provides for compensation to the owners of property
expropriated.
Proposed law limits the expropriation authority of the board by prohibiting any expropriation
of property within the parishes of E. Feliciana and St. Helena.
