ENERGY: Authorizes the governing authority of Allen Parish to determine whether Class
VI carbon dioxide injection wells may be permitted within the parish
1 AN ACT
2 To enact R.S. 30:1104(F) and 1104.3, relative to Class VI injection well permitting; to
3 authorize the governing authority of Allen Parish to determine whether Class VI
4 wells may be permitted within the parish; to provide for notice to the Department of
5 Energy and Natural Resources; to provide an effective date; and to provide for
6 related matters.
7 Notice of intention to introduce this Act has been published
8 as provided by Article III, Section 13 of the Constitution of
9 Louisiana.
10 Be it enacted by the Legislature of Louisiana:
11 Section 1. R.S. 30:1104(F) and 1104.3 are hereby enacted to read as follows:
12 §1104. Duties and powers of the commissioner; rules and regulations; permits

14 F. Notwithstanding any provision of law to the contrary, Class VI injection
15 wells shall not be permitted in any parish where prohibited pursuant to the local
16 option procedure set forth in this Chapter.

18 §1104.3. Local option; Allen Parish
19 The governing authority of Allen Parish may by resolution or ordinance
20 determine whether Class VI injection wells may be permitted within the parish. A

1 copy of any resolution or ordinance passed for this purpose shall be provided to the
2 department.
3 Section 2. This Act shall become effective upon signature by the governor or, if not
4 signed by the governor, upon expiration of the time for bills to become law without signature
5 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
6 vetoed by the governor and subsequently approved by the legislature, this Act shall become
7 effective on the day following such approval.
