2 To amend and reenact R.S. 3:3210(B), 3242(A), 3244, 3246(A), and 3251(B)(4), relative to
3 the Louisiana Pesticide Law; to provide for the disposition of unexpended and
4 unencumbered monies in the Pesticide Fund; to provide for the issuance of
5 certification cards for commercial applicators, pesticide salespersons, and
6 agricultural consultants; to provide for the renewal of such certificates; to provide
7 for fees for certain licenses and certificates issued or reissued by the commissioner;
8 and to provide for related matters.
9 Be it enacted by the Legislature of Louisiana:
10 Section 1. R.S. 3:3210(B), 3242(A), 3244, 3246(A), and 3251(B)(4) are hereby
11 amended and reenacted to read as follows:
12 §3210. Pesticide Fund

14 B. After compliance with the requirements of Article VII, Section 9(B) of
15 the Constitution of Louisiana relative to the Bond Security and Redemption Fund,
16 and prior to monies being placed in the state general fund, an amount equal to that
17 deposited as required by Subsection A hereof of this Section shall be credited to a
18 special fund hereby created in the state treasury to be known as the "Pesticide Fund".
19 The monies in this fund shall be used solely as provided in Subsection C hereof of
20 this Section and only in the amounts appropriated by the legislature. All unexpended
21 and unencumbered monies in this fund at the end of the fiscal year shall be returned
22 to the state general remain in the fund. The monies in this fund shall be invested by
23 the state treasurer in the same manner as monies in the state general fund, and
24 interest earned on the investment of these monies shall be credited to the state
25 general fund.

1 §3242. Certification of commercial applicators
2 A. No person shall apply or supervise the application of any restricted use
3 pesticide as a commercial applicator unless that person has the proper certification.
4 Certification shall be issued only after the applicant has satisfactorily passed an
5 examination. The commissioner shall establish categories and subcategories for
6 certification in different areas of commercial application and shall establish specific
7 standards for each category and subcategory. Certification shall be valid for three
8 years and shall be renewed in accordance with rules adopted by the commissioner.
9 The commissioner by rule shall provide for the issuance of annual certification cards
10 every three years to coincide with the certification renewal period. Commercial
11 applicators may supervise the ground application of restricted use pesticides within
12 the commercial applicator's certification by competent uncertified individuals who
13 are under the direct supervision of the commercial applicator. Commercial
14 applicators shall not supervise the aerial application of any pesticide by any
15 uncertified person.

17 §3244. Certification of pesticide salespersons
18 No person shall sell or supervise the sale of restricted use pesticides as a
19 pesticide salesperson unless that person has the proper certification. Certification
20 shall be issued only after the applicant has satisfactorily passed an examination.
21 Certification shall be valid for three years and shall be renewed in accordance with
22 rules adopted by the commissioner. The commissioner by rule shall provide for the
23 issuance of annual certification cards every three years to coincide with the
24 certification renewal period. Pesticide salespersons may supervise the sale of
25 restricted use pesticides by competent uncertified individuals who are under the
26 direct supervision of the pesticide salespersons.

28 §3246. Certification and licensing of agricultural consultants
29 A. No person shall be employed as an agricultural consultant unless that
30 person has the proper certification. Certification shall be issued only after the

1 applicant has satisfactorily passed an examination. Certification shall be valid for
2 three years and shall be renewed in accordance with rules adopted by the
