sequestration
1 AN ACT
2 To amend and reenact R.S. 30:1104(C)(introductory paragraph) and to enact R.S.
3 30:1104(C)(4), relative to carbon dioxide capture and sequestration; to require that
4 carbon dioxide for sequestration within the state be generated within Louisiana; to
5 require all enumerated conditions be met prior to the use of a reservoir for storage
6 or the exercise of eminent domain for storage of carbon dioxide; and to provide for
7 related matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 30:1104(C)(introductory paragraph) is hereby amended and
10 reenacted and R.S. 30:1104(C)(4) is hereby enacted to read as follows:
11 §1104. Duties and powers of the secretary; rules and regulations; permits

14 prior to the exercise of eminent domain pursuant to the provisions of R.S. 19:2(11)
15 and R.S. 30:1108 by any person, firm, or corporation having such right under laws
16 of the state of Louisiana, and as a condition precedent to such use or to the exercise
17 of such rights of eminent domain pursuant to the provisions of R.S. 19:2(11) and
18 R.S. 30:1108, the secretary, after public hearing pursuant to the provisions of R.S.

Present law (R.S. 30:1104(C)) provides for one of the conditions in an enumerated list of
conditions to be met prior to the use of any reservoir for storage and the exercise of eminent
