1 AN ACT
2 To enact R.S. 40:2401.4 and 2401.5, relative to pursuit intervention technology; to establish
3 a grant program within the Louisiana Commission on Law Enforcement and the
4 Administration of Criminal Justice for pursuit intervention safety and technology;
5 to integrate pursuit safety into the Strategic Highway Safety Plan; to establish the
6 Pursuit Safety and Officer Technology Fund as a special fund in the state treasury;
7 to provide for the transfer, deposit, and use, as specified, of monies in the Pursuit
8 Safety and Officer Technology Fund; to require the promulgation of rules and
9 regulations; and to provide for related matters.
10 Be it enacted by the Legislature of Louisiana:
11 Section 1. R.S. 40:2401.4 and 2401.5 are hereby enacted to read as follows:
12 §2401.4. Law Enforcement Pursuit Safety and Technology Grant Program; creation;
13 purpose; funding
14 A. The "Law Enforcement Pursuit Safety and Technology Grant Program"
15 is hereby created within the Louisiana Commission on Law Enforcement and
16 Administration of Criminal Justice, hereafter referred to as the "commission". The
17 purpose of the program is to provide funding assistance to state, parish, and
18 municipal law enforcement agencies for the acquisition and training related to
19 technology and devices designed to safely terminate high-speed vehicle pursuits.
20 B. The commission shall administer the program in accordance with uniform
21 guidelines promulgated by the commission.
22 C. Funds may be used for the pursuit intervention training or the purchase
23 of technology and devices to enhance pursuit safety, including but not limited to:
24 (1) GPS tracking projectiles.
25 (2) Vehicle-stopping nets or tethering systems, such as the Grappler.
26 (3) Remote-controlled tire deflation devices.

1 D. The commission is hereby authorized to receive funds, grants, donations,
2 or other assistance from any source, including federal funds available through the
3 Highway Safety Improvement Program under 23 U.S.C. 148, the Edward Byrne
4 Memorial Justice Assistance Grant Program, the National Highway Traffic Safety
5 Administration, the Homeland Security Grant Program, the Community Oriented
6 Policing Services Technology and Equipment Program, the Community Policing
7 Development Microgrants Program, and the Louisiana Department of Transportation
8 and Development in furtherance of the state's Strategic Highway Safety Plan for the
9 purposes of this program.
10 E. The commission shall prioritize grant applications from agencies that have
11 fully integrated the use of these technologies into their use-of-force and pursuit
12 policies and that emphasize law enforcement safety by reducing manual deployment
13 risks.
14 §2401.5. Pursuit Safety and Officer Technology Fund
15 A. There is hereby established in the state treasury, as a special fund, the
16 Pursuit Safety and Officer Technology Fund, hereinafter referred to in this Section
17 as the "fund".
18 B. After allocation of monies to the Bond Security and Redemption Fund as
19 provided in Article VII, Section (9)(B) of the Constitution of Louisiana, the treasurer
20 shall deposit into the fund monies transferred, appropriated, or dedicated to the fund.
21 Monies in the fund shall be appropriated by the legislature to the Louisiana
22 Commission on Law Enforcement and the Administration of Criminal Justice and
23 shall be used solely for the following purposes:
24 (1) Provide grants to state, parish, and municipal law enforcement agencies
25 for the acquisition of pursuit intervention technology, including but not limited to
26 GPS tracking projectiles, remote-deployment tire deflation devices, and
27 vehicle-tethering systems.
28 (2) Provide grants to state, parish, and municipal law enforcement agencies
29 for the development and implementation of training programs for the safe
30 deployment of pursuit intervention devices and technology.

1 (3) Administrative costs of the Louisiana Commission on Law Enforcement
2 and the Administration of Criminal Justice associated with the grant program, not to
3 exceed five percent of the annual fund balance.
4 C. Monies in the fund shall be invested in the same manner as monies in the
5 state general fund. Interest earned on investment of monies in the fund shall be
6 credited to the fund. Unexpended and unencumbered monies in the fund at the end
7 of the fiscal year shall remain in the fund.
8 Section 2. This Act shall be known and may be cited as the "Sergeant Grant Candies
9 Officer Safety Act".
