ALCOHOLIC BEVERAGES: Provides relative to microdistillers
1 AN ACT
2 To amend and reenact R.S. 26:71(A)(3)(d), relative to a microdistiller; to provide for a
3 permit; to provide for the cost of a permit; and to provide for related matters.
4 Be it enacted by the Legislature of Louisiana:
5 Section 1. R.S. 26:71(A)(3)(d) is hereby amended and reenacted to read as follows:
6 §71. Permits required; fees; exception
7 A. Except as provided in Subsections B and C of this Section, before
8 engaging in the business of manufacturing, supplying, or dealing in alcoholic
9 beverages, all persons shall obtain from the commissioner, according to established
10 rules and regulations, a permit to conduct each separate business and shall pay the
11 commissioner a fee not to exceed the amounts provided for in the following schedule
12 and in accordance with regulations promulgated pursuant to the provisions of the
13 Administrative Procedure Act for each year the permit is valid:

15 (3) Retailers - (a) There shall be three types of Class A retail liquor permits:

17 (d)(i) Microdistiller, which authorizes the holder of a Retailers Class A
18 permit to engage in the distilling, making, blending, rectifying, or processing of any
19 alcoholic beverage in Louisiana this state at a single location in an amount not to

1 exceed twelve thousand gallons per year, and which further authorizes the sale at
2 retail of such distilled beverages from that location - one thousand dollars.
3 (ii) Microdistiller, which authorizes the holder of a Retailers Class A permit
4 to engage in the distilling, making, blending, rectifying, or processing of any
5 alcoholic beverage in this state at a single location in an amount not to exceed one
6 thousand gallons per year, and which further authorizes the sale at retail of such
7 distilled beverages from that location - one hundred dollars.

Abstract: Provides for a permit and cost of permit for a microdistiller processing a certain
number of gallons per year.
Present law provides for the issuance of a Class A permit at a cost of $1,000 to a distiller
who distills, makes, blends, rectifies or processes alcoholic beverages of no more than
12,000 gallons per year.
Proposed law retains present law and provides for a new permit for the issuance of a Class
A permit at a cost of $100 to a distiller who distills, makes, blends, rectifies, or processes
alcoholic beverages of no more than 1,000 gallons per year.
