BY REPRESENTATIVES COATES AND CHASSION
1 AN ACT
2 To enact Part I of Chapter 12 of Title 30 of the Louisiana Revised Statutes of 1950, to be
3 comprised of R.S. 30:1121, relative to renewable energy; to require recycling of
4 decommissioned renewable energy components or infrastructure; to require costs for
5 recycling and decommissioning to be paid by the renewable energy provider; to
6 provide for an effective date; to direct the Louisiana State Law Institute to
7 redesignate certain provisions; and to provide for related matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1. Part I of Chapter 12 of Title 30 of the Louisiana Revised Statutes of 1950,
10 comprised of R.S. 30:1121 is hereby enacted to read as follows:
11 PART I. GENERAL PROVISIONS
12 §1121. Recycling; renewable energy
13 Any decommissioning plan required for a renewable energy facility shall
14 provide for the recycling of component parts of the facility to the extent practicable,
15 in accordance with the Department of Environmental Quality regulations pertaining
16 to Universal Wastes in Chapter 38 of Part V of Title 33 of the Louisiana
17 Administrative Code, Recyclable Materials in Chapter 41 of Part V of Title 33 of the
18 Louisiana Administrative Code, or Recycling and Waste Reduction Rules in Chapter
19 103 of Part VII of Title 33 of the Louisiana Administrative Code, except those parts
20 required to be disposed of otherwise by Subtitle II of this Title.
21 Section 2. The Louisiana State Law Institute is hereby authorized and directed to:
22 (A) Redesignate the part heading of R.S. 30:1131, "PART I. BATTERIES" as
23 "PART II. BATTERIES".
24 (B) Redesignate the part heading of R.S. 30:1141, "PART II. WIND ENERGY" as
25 "PART III. WIND ENERGY".
