1 AN ACT
2 To amend and reenact R.S. 47:9008(A)(9) and 9029(A)(3) and to enact R.S. 14:90(F) and
3 90.3(L) and R.S. 47:9002(31) and (32) and 9008(B), relative to the lottery; to
4 provide relative to the purchase of lottery tickets; to provide for the purchase of
5 lottery tickets through the internet; to provide for the duties and regulations of the
6 Louisiana Lottery Corporation; to provide for definitions; and to provide for related
7 matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 14:90(F) and 90.3(L) are hereby amended and reenacted to read as
10 follows:
11 §90. Gambling

13 F. The purchase of lottery tickets through the internet, as provided in R.S.
14 47:9008, shall not be considered gambling for the purposes of this Section.

1 Section 2. R.S. 47:9008(A)(9) and 9029(A)(3) are hereby amended and reenacted
2 and 9002(31) and (32) and 9008(B) are hereby enacted to read as follows:
3 §9002. Definitions
4 As used in this Subtitle, the following words and phrases shall have the
5 following meanings unless the context clearly requires otherwise:

7 (31) "I lottery" means the purchase of lottery tickets through the internet.
8 (32) "I lottery gross revenues" means the amount equal to the gross revenue
9 of all purchases of lottery tickets through the internet in which the player may
10 determine instantly if the ticket is a winning ticket less the total amount of all
11 winnings paid out to holders of winning lottery tickets purchased through the
12 internet.

14 §9008. Board; lottery games; regulation
15 A. The board may adopt rules for the conduct of specific lottery games and
16 operations, including but not limited to rules specifying:

18 (9) Any other matters necessary or desirable for the efficient and effective
19 operation of the lottery or for the convenience of the public, including the purchase
20 of lottery tickets through the internet.
21 B. The board shall adopt rules in accordance with the Administrative
22 Procedure Act to implement, administer, and regulate the purchase of lottery tickets
23 through the internet, including but not limited to the following:
24 (1) Requiring age verification methods that prohibit persons under the age
25 of twenty-one from purchasing lottery tickets through the internet.
26 (2) Requiring location verification methods that restrict the purchase of
27 lottery tickets through the internet to individuals physically located within this state
28 of Louisiana.

1 §9029. Deposit of revenues; expenditures and investments authorized; transfer of
2 revenues to state treasury; dedication and use of proceeds; corporation
3 operating account; audit of corporation books and records; audits

6 (3) Within twenty days following the close of each calendar month, the
7 corporation shall transfer to the Lottery Proceeds Fund in the state treasury the
8 amount of net revenues which the corporation determines are surplus to its needs.
9 Net revenues or proceeds shall be determined by deducting from gross revenues the
10 payment costs incurred or estimated to be incurred in the operation and
11 administration of the lottery. This shall include includes the expenses of the
12 corporation and the costs resulting from any contract or contracts entered into for
13 promotional, advertising, or operational services or for the purchase or lease of
14 lottery equipment and materials, fixed capital outlays, and the payment of prizes to
15 the holders of winning tickets. After the first year of operation, the corporation shall
16 transfer each year not less than twenty-five percent of gross revenues and I lottery
17 gross revenues to the state treasury.

19 Section 3. The Louisiana State Law Institute is hereby authorized and directed to
20 renumber the definitions in R.S. 47:9002 to ensure the definitions are in alphabetical order.

board of directors for the La. Lottery Corp. to adopt rules and regulations necessary
to implement, administer, and regulate such purchases.
Present law provides for the crimes of gambling (R.S. 14:90) and gambling by computer
(R.S. 14:90.3).
Proposed law adds an exception to the present law crimes for the purchase of lottery tickets
through the internet.

Present law authorizes the board of directors for the La. Lottery Corp. to adopt rules for the
conduct of specific lottery games and operations, including matters necessary or desirable
for the efficient and effective operation of the lottery or for the convenience of the public.
Proposed law amends present law to require the board to adopt rules for the purchase of
lottery tickets through the internet.
Proposed law further requires the board to adopt, pursuant to the APA, rules to administer
and regulate the purchase of lottery tickets through the internet, including age and location
verification methods.
Present law requires the La. Lottery Corp. to transfer 25% of lottery revenue to the state
treasury at the end of each year.
Proposed law retains present law and further requires the La. Lottery Corp. to annually
transfer 25% of online lottery revenue to the state treasury.
