1 AN ACT
2 To enact R.S. 38:2212.11, relative to the procurement of public motor vehicles and rolling
3 stock; to provide for an exception to the Louisiana Uniform Bid requirement; to
4 authorize the utilization of the Fixing America's Surface Transportation Act in the
5 procurement process; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 38:2212.11 is hereby enacted to read as follows:
8 §2212.11. Procurement of public motor vehicles; rolling stock and related
9 equipment procurement; Fixing America's Surface Transportation Act
10 A. The Louisiana legislature finds that the procurement of public motor
11 vehicles and rolling stock is an unnecessarily lengthy process. Current federal law,
12 the Fixing American's Surface Transportation Act (FAST Act), provides for long-
13 term funding certainty for surface transportation infrastructure planning and
14 investment and reestablished a Bus Discretionary Program to allow states to apply
15 for project-specific funding through cooperative purchases. In utilizing the FAST
16 Act, it has allowed for many state and local governments to streamline critical
17 transportation projects. At this time, Louisiana entities are barred from utilizing the
18 FAST Act based on the required use of the Louisiana Uniform Bid Form within R.S.
19 38:2212.

1 B. In addition to the procurement methods available to all political
2 subdivisions, the state of Louisiana and any local municipality, parish, or other
3 subdivision of the state may procure public motor vehicles and rolling stock and
4 related equipment using the methods approved by and in compliance with Section
5 3019 of the Public Law 114-94 (the FAST Act).
