1 AN ACT
2 To enact Part XIV of Chapter 1 of Title 17 of the Louisiana Revised Statutes of 1950, to be
3 comprised of R.S. 17:410.17 through 410.23, relative to education service providers
4 and vendors of educational products; to prohibit education agencies from contracting
5 with certain prohibited individuals and entities; to provide with respect to foreign
6 adversaries, foreign terrorist organizations, and agents thereof; to provide with
7 respect to the duties of education agencies; to provide for due process; to provide for
8 the suspension of payments; to provide for certain provisions to be included in
9 contracts; to provide relative to the duties and authority of the attorney general; to
10 provide relative to the office of debt recovery; to provide for legislative findings; to
11 provide definitions; to provide for effectiveness; and to provide for related matters.
12 Be it enacted by the Legislature of Louisiana:
13 Section 1. Part XIV of Chapter 1 of Title 17 of the Louisiana Revised Statutes of
14 1950, comprised of R.S. 17:410.17 through 410.23, is hereby enacted to read as follows:

2 ADVERSARIES AND FOREIGN TERRORIST ORGANIZATIONS
3 §410.17. Legislative findings
4 The legislature finds and declares that the people of Louisiana deserve the
5 highest assurance that no taxpayer dollars that are collected or spent for education
6 will be used to support entities with ties to foreign adversaries or foreign terrorist
7 organizations or their agents.
8 §410.18. Definitions
9 Unless otherwise indicated, the following definitions shall apply to this Part,
10 as follows:
11 (1) "Agent of a foreign adversary" means an agent directed or controlled by
12 a foreign adversary or the agent's proxy.
13 (2) "Agent of a foreign terrorist organization" means an agent directed or
14 controlled by a foreign terrorist organization or the agent's proxy.
15 (3) "Education agency" means the state Department of Education, the State
16 Board of Elementary and Secondary Education, any city, parish, or other local public
17 school board, any early learning center as defined in R.S. 17:407.33, and any other
18 state agency that has authority over educational institutions and educational
19 opportunities for students from early childhood through secondary education
20 pursuant to this Title or any other provision of law.
21 (4) "Education service provider" means an individual or a for-profit or
22 nonprofit organization or entity that contracts with an education agency to deliver
23 educational, operational, or management services.
24 (5) "Foreign adversary" means a country specified in 15 CFR 791.4 or a
25 successor regulation.
26 (6) "Foreign terrorist organization" means an entity designated by the United
27 States Department of State as a foreign terrorist organization in accordance with 8
28 U.S.C. 1189, or a successor law, or by the United States Department of the Treasury
29 as a "specially designated national" in accordance with 31 CFR 500.306, or a
30 successor regulation.

1 (7) "Vendor of educational products" means an individual or a for-profit or
2 nonprofit organization or entity that contracts with or sells goods, services, or
3 technology directly to an education agency.
4 §410.19. Prohibitions on contracting with foreign adversaries or foreign terrorist
5 organizations and their agents
6 A. No education agency shall knowingly contract with an education service
7 provider or a vendor of educational products who is a foreign adversary, an agent of
8 a foreign adversary, a foreign terrorist organization, or an agent of a foreign terrorist
9 organization.
10 B. No education service provider or a vendor of educational products shall
11 knowingly subcontract with a foreign adversary, an agent of a foreign adversary, a
12 foreign terrorist organization, or an agent of a foreign terrorist organization.
13 C. Knowingly acting as an agent, proxy, or contractor of a foreign adversary
14 or foreign terrorist organization is prohibited conduct which renders the agent, proxy,
15 or contractor ineligible to contract with an education agency or a primary contractor
16 of an education agency.
17 D. Providing material support or funds to a foreign adversary or a foreign
18 terrorist organization is prohibited conduct which renders the person ineligible to
19 contract with an education agency or a primary contractor of an education agency.
20 §410.20. Suspension of payments to foreign adversaries or foreign terrorist
21 organizations, their agents, or their subcontractors
22 A. If an education agency becomes aware that an education service provider
23 or a vendor of educational products is a foreign adversary, an agent of a foreign
24 adversary, a foreign terrorist organization, or an agent of a foreign terrorist
25 organization, the education agency shall immediately notify the attorney general and
26 suspend payments to the provider or vendor pending due process review as provided
27 in R.S. 17:410.21.
28 B. Subject to the due process rights provided in R.S. 17:410.21, if it is
29 determined that an education service provider or a vendor of education products is
30 not qualified to contract with an education agency pursuant to this Part, then the

1 provider or vendor shall return any payments received on or after the provider or
2 vendor became ineligible due to a violation of this Part.
3 §410.21. Due process rights of education service providers and vendors of
4 educational products
5 An education service provider or a vendor of educational products who is
6 denied a contract with an education agency or has a contract that is suspended
7 pursuant to this Part is entitled to avail itself of all administrative due process rights
8 and legal redress as provided in the Louisiana Procurement Code, R.S. 39:1551 et
9 seq., or the Public Bid Law, R.S. 38:2181 et seq., whichever is applicable.
10 §410.22. Notice provisions in contracts
11 Beginning on July 1, 2026, each education agency shall include in all
12 contracts with education service providers or vendors of educational products a
13 statement that the provisions of this Part apply to the contract and any payments
14 made thereto. The contract provision must also require the provider or vendor to
15 agree not to engage in conduct that would violate any provisions of this Part during
16 the term of the contract and that such prohibited conduct will result in an immediate
17 suspension of payments and be subject to debt collection as provided in this Part.
18 §410.23. Role of the attorney general
19 A. An education agency may seek the opinion of the attorney general as to
20 whether or not an education service provider or a vendor of educational products is
21 prohibited from contracting with the education agency, pursuant to R.S. 17:410.19
22 or R.S. 17:410.20.
23 B. If, pursuant to this Part, an education service provider or a vendor of
24 education products is deemed ineligible to contract or is determined to have engaged
25 in conduct which renders the provider or vendor ineligible or disqualified under the
26 contract and the contractor does not return any payments that are recoverable,
27 pursuant to R.S. 17:410.20, then notice of the recoverable debt shall be turned over
28 to the attorney general who, in conjunction with the office of debt recovery within
29 the Department of Revenue, shall institute recovery and collection of the debt.

1 Section 2. This Act shall become effective upon signature by the governor or, if not
2 signed by the governor, upon expiration of the time for bills to become law without signature
3 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
4 vetoed by the governor and subsequently approved by the legislature, this Act shall become
5 effective on the day following such approval.
