HIGHWAYS: Creates Louisiana legislator district signs on highways and roads in the state
1 AN ACT
2 To enact R.S. 48:274.4, relative to the creation of the Louisiana legislator district sign on
3 highways and roads within the state; to provide for the creation of signs in the
4 respective legislators' district and the district number; to provide for the design, fee,
5 and rule promulgation of the legislator district signs; and to provide for related
6 matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. R.S. 48:274.4 is hereby enacted to read as follows:
9 §274.4. Placing of legislator district signs; contracts with third parties
10 A.(1) The department may regulate the content, composition, placement,
11 erection, and maintenance of the legislator district signs within interstate and other
12 fully controlled access highway rights-of-way, or the department may contract with
13 a qualified third party or parties for the placement, erection, and maintenance of the
14 legislator district signs within interstate and other fully controlled access highway
15 rights-of-way. The department may expend any available federal funds for erecting
16 and maintaining the legislator district signs.
17 (2) If the department contracts with a qualified third party for the placement,
18 erection, and maintenance of the legislator district signs within interstate or other
19 fully controlled access highway rights-of-way, selection of the qualified third party
20 shall be made pursuant to the provisions of R.S. 39:1554(B). The department and

1 the qualified third party shall negotiate the terms and conditions of their contract;
2 however, the qualified third party shall be required to deposit all revenues received
3 pursuant to the contract into a separate account and provide the department with a
4 full accounting of such revenues every three months. The department may extend
5 the initial term of the contract for not more than four additional five-year periods.
6 (3) For purposes of this Section "legislator district signs" shall mean a
7 rectangular sign panel imprinted with the names of the respective legislators' names
8 and the district number on each sign as provided for in administrative rules
9 promulgated pursuant to this Section.
10 (4) The department shall establish appropriate and reasonable fees.
11 (5) The ownership of the legislator district signs erected and maintained by
12 a qualified third party shall be the property of the state of Louisiana.
13 B. All fees collected pursuant to the provisions of this Section shall be
14 considered as self-generated revenues and deposited by the secretary of the
15 Department of Transportation and Development into the state treasury for credit to
16 the Department of Transportation and Development. After compliance with the
17 requirements of Article VII, Section 9(B) of the Constitution of Louisiana relative
18 to the Bond Security and Redemption Fund, the monies so deposited shall be
19 appropriated as self-generated revenues to the Department of Transportation and
20 Development.
21 C.(1) The procedures for obtaining approval for programming, project
22 authorizations, and other actions for federal-aid projects which include these signs
23 shall follow the same procedures as other federal-aid projects in this state, as
24 prescribed in Title 23 of the Code of Federal Regulations Subpart C of Section 655
25 et seq.
26 (2) The department shall promulgate rules and regulations in accordance
27 with the Administrative Procedure Act as are necessary for the implementation of
28 this Section, including but not limited to rules and regulations relative to contracting
29 with a qualified third party.

Proposed law authorizes the Department of Transportation and Development (DOTD) to
regulate the content, composition, placement, erection, and maintenance of the La. legislator
district signs within interstate and other fully controlled access hwy. rights-of-way, or the
DOTD may contract with a qualified third party for the placement, erection, and
maintenance of the legislator district signs within interstate and other fully controlled access
highway rights-of-way. Authorizes the DOTD to expend any available federal funds for
erecting and maintaining the legislator district signs
Proposed law specifies that if the DOTD contracts with a qualified third party for the
placement, erection, and maintenance of the legislator district signs within interstate and
other fully controlled access highway rights-of-way, selection of the qualified third party

qualified third party must deposit all revenues received pursuant to the contract into a
