1 AN ACT
2 To enact R.S. 32:412.4 and R.S. 40:1321.3, relative to waiver of fees for office of motor
3 vehicles issued credentials; to provide for waiver of fees for Class "E" driver's
4 licenses and state identification cards for homeless persons; to provide for proof of
5 homelessness; to provide for restrictions to the waiver of fees; to limit the fee waiver
6 for certain credentials to residents of Louisiana; to provide for definitions; and to
7 provide for related matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 32:412.4 is hereby enacted to read as follows:
10 §412.4. Homelessness exemption; driver's licenses
11 A.(1) The department shall not charge a fee for issuing, renewing, or
12 providing a duplicate of any Class "E" driver's license for a person who is homeless.
13 The person shall demonstrate homelessness by presenting a letter, at the time of
14 application, attesting to his homelessness from either of the following entities:
15 (a) An established homeless shelter.
16 (b) An outreach or supportive service provider.
17 (c) A healthcare provider.
18 (d) A school homeless liaison staffer.

1 (e) A domestic violence service provider.
2 (2) For the purposes of this Section, the term "homeless" or "homelessness"
3 shall include a person living at or below one hundred percent of the federal poverty
4 line or as defined in 42 U.S.C. 11302.
5 B. The waiver of fees shall include the issuance, renewal, or duplicate of any
6 Class "E" driver's license.
7 C. The department shall waive a fee that would otherwise be charged for the
8 issuance of any Class "E" drivers license, if the individual confirms he is not in
9 violation of any provision contained in R.S. 32:414.
10 D. The provisions of this Section shall apply only to residents of the state of
11 Louisiana.
12 Section 2. R.S. 40:1321.3 is hereby enacted to read as follows:

licenses.
Proposed law requires the Dept. of Public Safety and Corrections (DPS&C), office of motor
vehicles (OMV) to waive the fees for issuing, renewing, or providing a duplicate Class "E"
driver's license if the resident is homeless, except if the individual's license has been
suspended, revoked, or cancelled.
Proposed law requires proof of homelessness in order to receive the waiver of fees for the
Class "E" driver's license by presenting a letter attesting to his homeless status. Specifies
that the letter must be provided by one of the following entities:
(1) An established homeless shelter.
(2) An outreach or supportive service provider.
(3) A healthcare provider.
(4) A school homeless liaison staffer.
(5) A domestic violence service provider.
Proposed law limits the fee waiver solely to La. residents.
Proposed law defines "homeless" or "homelessness" as a person living at or below 100% of
the federal poverty line or as defined in federal law.
Present law establishes a fee to issue or renew state identification cards. Requires a $3 fee
for a two-year identification card or $7.50 for a six-year identification card if the resident
is under 16 years old. Further requires a $15 fee for state identification cards for residents
over 16 years old.

providing a duplicate state identification card if the resident is homeless.
