HIGHWAYS: Prohibits leaving trash cans in the rights-of-way of state roads
1 AN ACT
2 To enact R.S. 48:261.1, relative to garbage receptacles on state road rights-of-way; to
3 prohibit persons from leaving garbage receptacles within a state road right-of-way
4 after the day of collection; to provide for fines; to provide for enforcement; and to
5 provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 48:261.1 is hereby enacted to read as follows:
8 §261.1. Receptacle removal; state road rights-of-way
9 A. All garbage and recycling receptacles placed in the right-of-way of a state
10 road for regularly scheduled curbside pickup shall be removed from the right-of- way
11 by the end of the day of collection.
12 B. Any person that fails to comply with the provisions of this Section shall
13 be subject to the following fines:
14 (1) One hundred dollars for a first offense.
15 (2) Two hundred dollars for a second offense.
16 (3) Three hundred dollars for a third or subsequent offense.
17 C. Any political subdivision responsible for maintaining the right-of-way of
18 a state road may enforce the provisions of this Section as to the rights-of-way it
19 maintains.

Abstract: Prohibits persons from leaving garbage and recycling receptacles in the right-of-
way of a state road after the day of regularly scheduled collection and imposes a fine
for noncompliance.
Proposed law requires that all garbage and recycling bins put in a state road right-of-way for
regularly scheduled collection be removed by the end of collection day.
Proposed law provides that noncompliance with proposed law will subject a person to the
following fines:
(1) $100 for a first offense.
(2) $200 for a second offense.
(3) $300 for a third or subsequent offense.
Proposed law authorizes any political subdivision, including the state, parishes, or
municipalities, that maintains the right-of-way for a state road to enforce proposed law on
those rights-of-way that it maintains.
