MTR VEHICLE/OFFICE: Provides relative to reinstatement fees for certain motor vehicle
violations
1 AN ACT
2 To amend and reenact R.S. 32:414(I)(1) and to enact R.S. 32:414(X), relative to
3 reinstatement fees for suspended licenses based on operating a motor vehicle while
4 under the influence of alcohol or narcotics; increases reinstatement fees for
5 suspended licenses based on operating a motor vehicle while under the influence of
6 alcohol or narcotics; to provide for increases in fees pursuant to the Consumer Price
7 Index for All Urban Consumers; and to provide for related matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 32:414(I)(1) is hereby amended and reenacted and R.S. 32:414(X)
10 is hereby enacted to read as follows:
11 §414. Suspension, revocation, renewal, and cancellation of licenses; judicial review

13 I.(1) The reinstatement fee for a license of a person who has been convicted
14 of or forfeited bond on or entered a plea of guilty or nolo contendere to a charge of
15 operating a motor vehicle while under the influence of beverages of high alcoholic
16 content, of low alcoholic content, of narcotic drugs, or of central nervous system
17 stimulants shall be one hundred fifty dollars if one conviction appears listed on his
18 record prior to application for reinstatement; two hundred fifty dollars if two such
19 convictions appear on his record prior to application for reinstatement; and three
20 hundred fifty dollars for each conviction on his record after the second conviction

1 prior to application for reinstatement, and the requirements of R.S. 32:896 relative
2 to proof of financial responsibility have been satisfied.

4 X. For an initial adjustment of fees, the office of motor vehicles shall
5 determine the percentage increase in the Consumer Price Index for All Urban
6 Consumers, or CPI-U, for the period beginning August 1, 2026, and ending January
7 31, 2028. Beginning July 1, 2028, the office of motor vehicles shall make an annual
8 adjustment increasing all the fees contained in this Section by a percentage not to
9 exceed the annual increase in the CPI-U in the preceding year.

Abstract: Increases the reinstatement fee for drivers' licenses suspended based on operating
a motor vehicle while under the influence of alcoholic or narcotic drugs.
Present law requires a person convicted of or forfeited bond on or entered a plea of guilty
or nolo contendere to a charge of operating a motor vehicle while under the influence of
beverages of high alcoholic content, of low alcoholic content, of narcotic drugs, or of central
nervous system stimulants pay a driver's license reinstatement fee of $100 for a first offense,
$200 for a second offense, and $300 for any subsequent offense.
Proposed law changes the reinstatement fee for a first offense fee from $100 to $150, for a
second offense fee from $200 to $250, and for any subsequent offense fee from $300 to
$350.
Proposed law requires the office of motor vehicles (OMV) utilize an initial adjustment of
fees to determine the percentage increase in the Consumer Price Index for All Urban
Consumers (CPI-U) for the period beginning August 1, 2026, and ending Jan. 31, 2028.
Beginning July 1, 2028, the OMV must make an annual adjustment to increase all the fees
continued in present law and proposed law on an annual basis tied to the CPI-U.
