2 To amend and reenact R.S. 32:387(A), relative to statewide uniform permits for oversized
3 vehicles; to remove the requirement that a vehicle obtain a special permit from an
4 agency or department or political subdivision other than the Department of
5 Transportation and Development; to provide for a one year moratorium on the
6 issuance of any local permits for oversized vehicles; to provide exceptions; and to
7 provide for related matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 32:387(A) is hereby amended and reenacted to read as follows:
10 §387. Special permits
11 A.(1) No vehicle or combination of vehicles that does not meet the
12 requirements of R.S. 32:380 through 386 shall use the public highways of this state
13 without first obtaining a special permit from the department in addition to any other
14 special permit which may be required from any other agency or department of the
15 state or a political subdivision, and the special permit herein provided for in this
16 Section shall be issued at the discretion of the secretary. If a permit issued pursuant
17 to Subsection B of this Section authorizes a vehicle to operate on interstate
18 highways, the secretary may allow the vehicle to operate on interstate highways at
19 night if requested by the owner or operator.
20 (2) The provisions of this Subsection shall not apply to the parishes of
21 Bossier and Caddo.

1 Section 2. A moratorium is hereby established, for a period of one year from the
2 effective date of this Act, on the enactment or adoption of any ordinance, rule, or regulation
3 that creates or modifies permit requirements for oversized vehicles. During this moratorium,
4 political subdivisions may continue to issue permits under existing requirements but shall
5 not adopt or implement any new or revised permit requirements for oversized vehicles.
6 Section 3. This Act shall become effective upon signature by the governor or, if not
7 signed by the governor, upon expiration of the time for bills to become law without signature
8 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
9 vetoed by the governor and subsequently approved by the legislature, this Act shall become
10 effective on the day following such approval.
