2 To amend and reenact R.S. 38:2316 and to enact R.S. 38:2310(11), relative to indefinite
3 delivery and indefinite quantity professional design services contracts; to provide for
4 definitions; to provide for selection procedures and advertising; to require
5 submission of professional qualifications; to establish contract limits, terms, and
6 amendments for certain projects; to require agency compliance for issuing task
7 orders; to clarify the applicability of existing law to all other professional design
8 services contracts; to provide for an effective date; and to provide for related matters.
9 Be it enacted by the Legislature of Louisiana:
10 Section 1. R.S. 38:2316 is hereby amended and reenacted and R.S. 38:2310(11) is
11 hereby enacted to read as follows:
12 §2310. Definitions
13 As used in this Part, the following words and phrases shall have the meanings
14 hereinafter set forth unless the context clearly requires otherwise:

16 (11) "Indefinite delivery and indefinite quantity professional design services
17 contract" means a master contract for professional design services where an agency
18 can issue multiple, separate task orders to the designer for different design efforts.

20 §2316. Applicability; indefinite delivery and indefinite quantity professional design
21 services contracts
22 A. Except as provided in R.S. 38:2311(C), the provisions of this Part shall
23 not apply to professional design service contracts in which the estimated construction
24 project budget cost is one million dollars or less.

1 B.(1) Except as provided in R.S. 38:2311(C), the selection of professional
2 design services contracts allowing for indefinite delivery and indefinite quantity
3 design services shall be governed by the provisions of this Section.
4 (2)(a) Each agency intending to contract for indefinite delivery and indefinite
5 quantity professional design services shall notify the division of administration of
6 such intention and shall provide the division of administration with all necessary
7 information concerning the scope of services sought. The division of administration
8 shall then evaluate the proposed indefinite delivery and indefinite quantity
9 professional design services sought for purposes of determining the professional
10 services to be required in order to refer the agency request to the proper board. The
11 division of administration shall then advise the chairmen of the boards as to which
12 selection board the proposed agency request has been referred.
13 (b) If the chairman of any of the three professional selection boards referred
14 to in this Subparagraph objects to a referral made by the division of administration,
15 that objection shall be submitted to the division of administration, and the division
16 of administration shall submit the information concerning the proposed agency
17 request to a committee composed of the following:
18 (i) The chairman of the Louisiana Architects Selection Board.
19 (ii) The chairman of the Louisiana Engineers Selection Board.
20 (iii) The chairman of the Louisiana Landscape Architects Selection Board.
21 (iv) The head, or representative named by the head, of the user agency whose
22 request is under consideration, and the commissioner of the division of
23 administration or his designee.
24 (c) The members of the committee, by majority vote, shall designate which
25 selection board shall have the authority and responsibility for selecting the design
26 professionals and shall notify the division of administration of its decision. The
27 division of administration shall notify the board which has been designated the
28 responsibility of selecting the design professionals.
29 (d) The designated board shall then advertise one time in the official state
30 journal the following information:

1 (i) The professional services required.
2 (ii) The name, location, and user agency for which the professional services
3 is required.
4 (iii) Time and instructions for applicants to submit applications for
5 employment to the appropriate board.
6 (iv) General description of the design services sought, and the availability
7 of details upon request.
8 (v) The contract term limit set forth in Paragraph (4) of this Subsection.
9 (vi) The maximum fee and method for calculating total design contract
10 value, which shall be determined by the division of administration.
11 (vii) The number of design professionals to be selected.
12 (e) Any person who desires to be considered for an indefinite delivery and
13 indefinite quantity professional design services contract may submit data to the
14 appropriate selection board concerning his experience, previous projects undertaken,
15 present state projects now being performed by him or his firm for an agency, scope
16 and amount of work on hand, the names of key personnel who may be assigned to
17 work under the contract, and any other information that may be appropriate. The
18 boards may develop standard forms to be used for submitting such data.
19 (3) An indefinite delivery and indefinite quantity professional design
20 services contract under this Section shall not include design services for new
21 buildings. Single task order for renovations shall not exceed thirteen million dollars.
22 (4) An indefinite delivery and indefinite quantity professional design
23 services contract issued under this Section shall have a term not to exceed two years
24 and shall have a maximum total fee of one million dollars.
25 (5) Amendments to individual task orders issued within the two-year term
26 of the indefinite delivery and indefinite quantity professional design services contract
27 may be executed, including after the expiration of the contract and such amendments
28 may increase the total design contract value, but not the fee, above one million
29 dollars, provided such amendments shall be related to services necessary for the
30 completion of ongoing projects.

1 (6) Each agency issuing indefinite delivery and indefinite quantity
2 professional design services contracts under this Section shall maintain a minimum
3 of two such contracts in effect at all times. Where an agency has only one indefinite
4 delivery and indefinite quantity professional design services contract in effect, the
5 agency shall proceed under the provisions of R.S. 38:2316(B)(2) at the next available
6 selection board. In the event an agency does not comply with the requirements of
7 this Subsection, no further task orders may be issued on the one indefinite delivery
8 and indefinite quantity professional design services contract in effect.
9 C. The provisions of this Section shall not be construed to invalidate or
10 otherwise impact the validity of any other professional design service contract
11 regulated by this Title, including design-build or construction manager at risk
12 contracts.
13 Section 2. This Act shall become effective upon signature by the governor or, if not
14 signed by the governor, upon expiration of the time for bills to become law without signature
15 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
16 vetoed by the governor and subsequently approved by the legislature, this Act shall become
17 effective on the day following such approval.
