CIVIL/LAW: Establishes strict liability for damages caused from carbon storage and
transportation
1 AN ACT
2 To enact R.S. 9:2800.31, relative to liability for an owner or operator of a carbon dioxide
3 storage facility or transportation pipeline; to establish strict liability; and to provide
4 for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 9:2800.31 is hereby enacted to read as follows:
7 §2800.31. Liability of an owner or operator of a carbon dioxide storage facility or
8 pipeline transporting carbon dioxide for geologic storage
9 The owner or operator of a carbon dioxide storage facility or pipeline
10 transporting carbon dioxide for geologic storage shall be strictly liable for any
11 damages caused by an authorized release or loss of containment of carbon dioxide.
