CIVIL/LAW: Provides relative to medical liens
1 AN ACT
2 To amend and reenact R.S. 9:4752, relative to proceeds collected from third parties in favor
3 of medical providers for services furnished to injured persons; to provide relative to
4 medical liens; to provide relative to litigation costs; and to provide for related
5 matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 9:4752 is hereby amended and reenacted to read as follows:
8 §4752. Privilege on net proceeds collected from third party in favor of medical
9 providers for services and supplies furnished injured persons
10 A. A health care healthcare provider, hospital, or ambulance service that
11 furnishes services or supplies to any injured person shall have a privilege for the
12 reasonable charges or fees of such health care healthcare provider, hospital, or
13 ambulance service on the net amount payable to the injured person, his heirs, or legal
14 representatives, out of the total amount of any recovery or sum had, collected, or to
15 be collected, whether by judgment or by settlement or compromise, from another
16 person on account of such injuries, and on the net amount payable by any insurance
17 company under any contract providing for indemnity or compensation to the injured
18 person. The privilege of an attorney shall have precedence over the privilege created
19 under this Section.

1 B. A healthcare provider, hospital, or ambulance service shall be responsible
2 for up to twenty percent of litigation costs, as ordered by the court.

Abstract: Provides relative to litigation costs associated with medical liens.
Present law (R.S. 9:4752) provides that a healthcare provider, hospital, or ambulance service
that furnishes services or supplies to any injured person shall have a privilege for the
reasonable charges or fees.
Proposed law retains present law and provides that a healthcare provider, hospital, or
ambulance service shall be responsible for up to 20% of litigation costs, as ordered by the
court.
