1 AN ACT
2 To amend and reenact R.S. 15:555(A)(introductory paragraph) and 622(A)(introductory
3 paragraph), (1), (2), and (4) and (C) and R.S. 40:1216.1(A)(introductory paragraph)
4 and to enact R.S. 15:555(A)(18) and R.S. 46:2166(A)(19), relative to survivors of
5 sexually-oriented criminal offenses; to provide relative to sexual assault collection
6 kits; to provide for definitions; to provide relative to procedures and reporting
7 requirements; to provide relative to the membership of certain commissions; to
8 provide for technical revisions; and to provide for related matters.
9 Be it enacted by the Legislature of Louisiana:
10 Section 1. R.S. 15:555(A)(introductory paragraph) and 622(A)(introductory
11 paragraph), (1), (2), and (4) and (C) are hereby amended and reenacted and R.S.
12 15:555(A)(18) is hereby enacted to read as follows:
13 §555. Louisiana Sexual Assault Oversight Commission; creation; membership;
14 meetings
15 A. The Louisiana Sexual Assault Oversight Commission is hereby created
16 within the Department of Justice, office of the attorney general., The commission
17 and shall consist of the following members:

1 (18) A member with experience in forensic medical examinations provided
2 to victims of sexually-oriented criminal offenses who is selected by the Department
3 of Justice, office of the attorney general.

5 §622. Sexual assault collection kits
6 A. As used in this Section, the following terms have the following meanings:
7 (1) "Criminal justice agency" means any government agency or subunit
8 thereof, or of that agency or a private agency that, through statutory authorization or
9 a legal formal agreement with a governmental unit or agency, has does any of the
10 following:
11 (a) Has the power of investigation, arrest, detention, prosecution,
12 adjudication, treatment, supervision, rehabilitation or release of persons suspected,
13 charged, or convicted of a crime; or that collects,.
14 (b) Collects, stores, processes, transmits, or disseminates criminal history
15 record or crime information.
16 (2) "Forensic medical examination" means an examination provided to the
17 victim of a sexually oriented sexually-oriented criminal offense by a health care
18 healthcare provider for the purpose of gathering and preserving evidence of a sexual
19 assault for use in a court of law. A forensic medical examination shall include the
20 following:

22 (4) "Sexually oriented Sexually-oriented criminal offense" shall have has the
23 same meaning as sex offense as defined in R.S. 15:541(24).

25 C. By March 1, 2015, the Louisiana State Police Crime Laboratory shall
26 prepare and transmit a report to the chairman of the Senate Committee on Judiciary
27 B and the chairman of the House of Representatives Committee on Judiciary
28 containing the following:

1 (1) The number of untested sexual assault collection kits being stored by
2 each parish, by and each criminal justice agency, and the date the untested kit was
3 collected.
4 (2) The report shall also include the The name and contact information of
5 each criminal justice agency that failed to submit the report required by Subsection
6 B of this Section.
7 Section 2. R.S. 40:1216.1(A)(introductory paragraph) is hereby amended and
8 reenacted to read as follows:
9 §1216.1. Procedures for survivors of a sexually oriented sexually-oriented criminal
10 offense; immunity; regional plans; maximum allowable costs; definitions;
11 documents requested by victim
12 A. All licensed hospitals and healthcare providers in Louisiana this state
13 shall offer every sexual assault survivor information to receive the treatment
14 provided for in this Section. A licensed hospital or healthcare provider shall adhere
15 to the following procedures if a person presents for treatment as a sexual assault
16 survivor:

18 Section 3. R.S. 46:2166(A)(19) is hereby enacted to read as follows:
19 §2166. Composition of the commission
20 A. The commission shall be composed of the following members:

the attorney general.
