2 To enact R.S. 33:2740.70.11, relative to the parishes of Jefferson and Orleans; to create the
3 West End Economic Development District within the parishes; to provide relative
4 to the boundaries, purpose, governance, and powers and duties of the district; to
5 provide for district funding; to provide for effectiveness; and to provide for related
6 matters.
7 Notice of intention to introduce this Act has been published
8 as provided by Article III, Section 13 of the Constitution of
9 Louisiana.
10 Be it enacted by the Legislature of Louisiana:
11 Section 1. R.S. 33:2740.70.11 is hereby enacted to read as follows:
12 §2740.70.11. West End Economic Development District
13 A. There is hereby created within the parishes of Jefferson and Orleans, as
14 more specifically provided in Subsection B of this Section, a body politic and
15 corporate which shall be known as the West End Economic Development District,
16 referred to in this Section as the "district". The district shall be a political
17 subdivision of the state as defined in the Constitution of Louisiana.
18 B. The boundaries of the district shall encompass the following area:

1 C.(1) The district is established for the primary object and purpose of
2 promoting and encouraging economic and commercial development and tourism
3 opportunities, stimulating the economy through renewed commerce, industry,
4 research, and tourism, and for the utilization and development of natural and human
5 resources of the area by providing job opportunities.
6 (2) Nothing shall prohibit the district from providing public infrastructure
7 outside the boundaries of the district that generally benefits the public.
8 D.(1) The district shall be governed by a board of commissioners, referred
9 to in this Section as the "board", consisting of five members as follows:
10 (a) The member of the governing authority of the parish of Jefferson who
11 represents District No. 5 shall appoint two members.
12 (b) The member of the governing authority of the city of New Orleans who
13 represents District A shall appoint two members.
14 (c) The president of the governing authority of the city of New Orleans shall
15 appoint one member.
16 (2) Members of the board shall serve five-year terms after initial terms as
17 provided in this Paragraph. One member shall serve an initial term of one year; one
18 shall serve two years; one shall serve three years; one shall serve four years; and one
19 shall serve five years, as determined by lot at the first meeting of the board.
20 (3) Any vacancy which occurs prior to the expiration of the term for which
21 a member of the board has been appointed shall be filled for the remainder of the
22 unexpired term in the same manner as the original appointment.
23 (4) The board shall elect from its members a president, a vice president, a
24 secretary, a treasurer, and such other officers as it may deem necessary. The duties
25 of the officers shall be fixed by the bylaws adopted by the board.
26 (5) The minute books and archives of the district shall be maintained by the
27 secretary of the board. The monies, funds, and accounts of the district shall be in the
28 official custody of the board.
29 (6) The board shall adopt such rules and regulations as it deems necessary
30 or advisable for conducting its business affairs. It shall hold regular meetings as shall

1 be provided for in the bylaws and may hold special meetings at such times and
2 places within the district as may be prescribed in the bylaws.
3 (7) A majority of the members of the board shall constitute a quorum for the
4 transaction of business. The board shall keep minutes of all meetings and shall make
5 them available through the secretary of the board to residents of the district.
6 (8) The members of the board shall serve without compensation; however,
7 they may be reimbursed for expenses incurred while attending to the business of the
8 board or the district.
9 E. The district, acting by and through its board, shall have and exercise all
10 powers of a political subdivision necessary or convenient for carrying out its objects
11 and purposes, including but not limited to the following:
12 (1) To sue and to be sued.
13 (2) To adopt, use, and alter at will a corporate seal.
14 (3) To adopt bylaws and rules and regulations.
15 (4) To receive by gift, grant, or donation any sum of money, property, aid,
16 or assistance from the United States, the state of Louisiana, or any political
17 subdivision thereof, or any person, firm, or corporation.
18 (5) To enter into contracts, agreements, or cooperative endeavors with the
19 state and its political subdivisions or political corporations and with any public or
20 private association, corporation, business entity, or individual.
21 (6) To appoint officers, agents, and employees; prescribe their duties; and
22 fix their compensation.
23 (7) To acquire by purchase, gift, grant, donation, or lease property as may
24 be necessary or desirable for carrying out the objectives and purposes of the board.
25 (8) To perform any other necessary and ancillary acts to effectuate its
26 functions, to perform its duties, or to give effect to its powers in accordance with this
27 Section.
28 F.(1) In addition to the authority provided to the district by this Section, the
29 district may levy and collect a sales and use tax within the boundaries of the district
30 not to exceed two percent.

1 (2) The tax shall be imposed by resolution of the board and shall be levied
2 upon the sale at retail, the use, the lease or rental, the consumption, the distribution,
3 and the storage for use or consumption of tangible personal property or digital
4 products and upon the sales of services within the boundaries of the district, all as
5 defined in R.S. 47:301 et seq. The purpose and rate of the tax shall be as provided
6 in the resolution.
7 (3) Except where inapplicable, the procedure established by R.S. 47:301 et
8 seq. shall be followed in the imposition, collection, and enforcement of the tax, and
9 procedural details necessary to supplement those Sections and to make them
10 applicable to the tax authorized in this Subsection shall be fixed in the resolution
11 imposing the tax.
12 (4) The tax shall be imposed and collected uniformly throughout the
13 jurisdiction of the district.
14 (5) The tax levied pursuant to this Subsection shall be in addition to all other
15 taxes other political subdivisions within the jurisdiction of the district are authorized
16 to levy and collect.
17 (6) Any monies received by the district shall be used exclusively for the
18 benefit of the district and to fund economic development projects and infrastructure
19 improvement projects within the following described boundaries:
20 That portion of the protection or revetment levee bordering on Lake
21 Pontchartrain, and lying between the west bank of the New Basin Canal on the east,
22 and shore of Lake Pontchartrain on the west; all lands now lying under the waters of
23 Lake Pontchartrain between the protection or revetment levee on the south; the west
24 bank of the New Basin Canal on the East, the shore of Lake Pontchartrain on the
25 west and a line drawn parallel to and in front of said protection or revetment levee,
26 a distance of three thousand feet therefrom on the north; all lands now lying under
27 the waters of Lake Pontchartrain in the rear or south of the aforesaid protection or
28 revetment levee on the north, the shore of Lake Pontchartrain on the south and the
29 lands belonging to private persons on the east and west.
