TRANSPORTATION DEPT: Allocates money damages to highways to a state general fund
1 AN ACT
2 To enact Chapter 38 of Title 48 of the Louisiana Revised Statutes of 1950, to be comprised
3 of R.S. 48:2251 and 2252, relative to damages to state property; to provide for funds
4 recovered from a traffic accident recovered by the Department of Transportation and
5 Development; to establish a fund for repairing damage to state property; and to
6 provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. Chapter 38 of Title 48 of the Louisiana Revised Statutes of 1950, to be
9 comprised of R.S. 48:2251 and 2252, is hereby enacted to read as follows:
10 CHAPTER 38. DAMAGE RECOVERY FUND
11 §2251. Recovery fund; creation
12 The department shall establish a fund for the collection of funds recovered
13 by the state for damage to state property which occurs from traffic accidents or other
14 accidents that cause damage to state property on state highways.
15 §2252. Use of funds
16 A. Funds collected under this Chapter shall be utilized by the department to
17 repair the damage in the district in which it was caused or to refund the payment for
18 repairs from damage caused by traffic accidents already paid by the district or by the
19 local governing authority.

1 B. The provisions of this Chapter shall exclude the costs expended by the
2 department to recover the funds from the responsible party who caused the damage
3 to the state property.

and Development.
Proposed law requires the Dept. of Transportation and Development to establish a fund for
the collection of funds recovered by the dept. for damage caused to state property by traffic
accidents.
Proposed law requires that the funds collected be utilized to repair the damaged state
property or to reimburse the district or local governing authority that paid for the repairs to
state property.
Proposed law excludes any costs expended by the dept. to recover the funds from the party
responsible for causing the damage to state property.
