INSURANCE/HEALTH: Requires drug manufacturers to limit pricing of GLP-1
medications for health insurance plans
1 AN ACT
2 To enact R.S. 22:1034.2 and Part IX of Chapter 5-E of title 40 of the Louisiana Revised
3 Statutes of 1950, to be comprised of R.S. 40:1259.11, relative to require drug
4 manufacturers to limit pricing of GLP-1 medications for health insurance plans; to
5 provide for definitions; to provide for application of coverage plans; to provide for
6 Medicaid coverage; and to provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. R.S. 22:1034.2 is hereby enacted to read as follows:
9 §1034.2. Drug manufacturer limitations on the pricing of GLP-1 medications for
10 health insurance plans; limit on cost-sharing requirement
11 A. As used in this Section, the following terms apply:
12 (1) "Drug formulary" or "formulary" has the same meaning as provided in
13 R.S. 22:1060.1.
14 (2) "Enrollee" or "insured" has the same meaning as provided in R.S.
15 22:1872.
16 (3) "Glucagon-Like Peptide-1" known as GLP-1 means a natural gut
17 hormone that helps control blood sugar, digestion, and appetite. GLP-1 medications
18 can be injectable or administered orally, whichever form of the drug is available.
19 (4) "Health coverage plan" has the same meaning as provided in R.S.
20 22:1034.1.

1 B. Limitations on GLP-1 medications for drug manufacturers shall apply to
2 any health coverage plan for whom a provider issues a prescription, regardless of the
3 insured's specific medical condition or diagnosis.
4 (1) A health coverage plan shall not impose a cost-sharing provision for
5 GLP-1 medications in the health coverage plan's formulary if the total amount the
6 insured is required to pay exceeds two hundred dollars per prescription for a
7 thirty-day supply, regardless of the amount or type of GLP-1 medication needed to
8 fill the insured's prescription.
9 Section 2. Part IX of Chapter 5-E title 40 of the Louisiana Revised Statutes of 1950,
10 comprised of R.S. 40:1259.11, is hereby enacted to read as follows:
11 §1259.11 GLP-1 medications; Medicaid coverage
12 A. The Louisiana Medicaid program shall make available to persons who are
13 eligible for Medicaid benefits under Title XIX of the Social Security Act, 42 U.S.C.
14 1396 et seq., coverage benefits for GLP-1 medications regardless of the enrollee's
15 specific medical condition or diagnosis, when a provider issues a prescription.
16 B. The Louisiana Department of Health may seek approval of a federal
17 Medicaid waiver and state plan amendments as may be necessary to implement the
18 provisions of this Section.
