UTILITY/RATES: Provides relative to increases for certain utility rates
1 AN ACT
2 To enact Part IX of Chapter 9 of Title 45 of the Louisiana Revised Statutes of 1950, to be
3 comprised of R.S. 45:1350.1 through 1350.3, relative to increases for certain utility
4 rates; to provide definitions; to prohibit certain rate increases for utilities; to provide
5 for rulemaking by the commission; to provide for an effective date; and to provide
6 for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. Part IX of Chapter 9 of Title 45 of the Louisiana Revised Statutes of 1950,
9 comprised of R.S. 45:1350.1 through 1350.3, is hereby enacted to read as follows:
10 PART IX. ENERGY COSTS FROM DATA CENTERS
11 §1350.1. Definitions
12 For the purposes of this Part, the following definitions have the following
13 meanings:
14 (1) "Commission" means the Public Service Commission.
15 (2) "Data center" means a facility or group of facilities used primarily for the
16 storage, processing, or distribution of digital data, including but not limited to
17 facilities supporting cloud computing, artificial intelligence training or inference,
18 cryptocurrency mining, or large-scale server operations, that impose new or
19 expanded electric demand of fifty megawatts or more.

1 (3) "Household customer" means a residential electric customer of a
2 common carrier and public utility regulated by the commission.
3 (4) "New electric demand for data centers" means any incremental load,
4 infrastructure, generation, transmission, or distribution costs reasonably attributable
5 to serving or interconnecting a data center, including but not limited to new power
6 plants, transmission lines, substations, upgrades, or capacity additions approved or
7 placed in service.
8 §1350.2. Prohibition on utility rate increase
9 A.(1) Notwithstanding any other provision of law to the contrary, no electric
10 public utility subject to the jurisdiction of the commission shall increase the price,
11 rate, or charge paid by any household customer as a direct or indirect result of new
12 electric demand for data centers.
13 (2) No electric public utility shall recover any costs attributable to new
14 electric demand for data centers from household customers.
15 B. The commission shall ensure that all costs associated with new electric
16 demand for data centers, including but not limited to generation, transmission,
17 distribution, fuel, operations and maintenance, depreciation, return on investment,
18 and any stranded costs, are allocated solely to the data center customer or customers
19 causing such demand through special contracts, tariffs, or rate classes that do not
20 permit any portion of such costs to be recovered from household customers.
21 §1350.3. Duties of the commission
22 A. The commission shall promulgate rules and regulations to implement
23 cost-causation principles for data centers.
24 B. The rules outlined in Subsection A of this Section shall include all of the
25 following:
26 (1) Mandatory separate rate classes or special contracts for data centers that
27 ensure full cost recovery from the data center without cross-subsidization.
28 (2) Prohibition on any subsidy, explicit or implicit, from household or other
29 non-data-center customers.

1 (3) Requirements for long-term contracts, a minimum fifteen years with data
2 centers that include provisions for full cost responsibility, including cost overruns,
3 decommissioning, and potential early termination or abandonment.
4 (4) Procedures for independent prudence reviews of utility investments
5 serving data centers.
6 C. The commission shall deny any rate adjustment, tariff change, or
7 certificate of public convenience and necessity that would result in household
8 customers bearing any portion of costs associated with new electric demand for data
9 centers.
10 Section 2. This Act shall apply only to any actions taken on or after the effective
11 date of this Act.
12 Section 3. This Act shall become effective upon signature by the governor or, if not
13 signed by the governor, upon expiration of the time for bills to become law without signature
14 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
15 vetoed by the governor and subsequently approved by the legislature, this Act shall become
16 effective on the day following such approval.

Proposed law provides that the commission shall promulgate rules and regulations to
implement cost-causation principles for data centers.
Proposed law provides that the commission shall deny any rate adjustment, tariff change, or
certificate of public convenience and necessity that would result in household customers
bearing any portion of costs associated with new electric demand for data centers.
Proposed law provides that proposed law shall apply only to any actions taken on or after
the effective date of proposed law.
Effective upon signature of governor or lapse of time for gubernatorial action.
