MEDICAID: Provides relative to the Medicaid Pharmaceutical and Therapeutics
Committee
1 AN ACT
2 To amend and reenact R.S. 46:153.3, to enact R.S. 46:153.3(D)(2)(a)(xii), and to repeal R.S.
3 46:153.3(C)(1), relative to the Medicaid Pharmaceutical and Therapeutics
4 Committee; to provide for changes in the committee's composition; to provide for
5 the removal of certain restrictions related to HIV/AIDS medications; and to provide
6 for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. R.S. 46:153.3 is hereby amended and reenacted and R.S.
9 46:153.3(D)(2)(a)(xii) is enacted to read as follows:
10 §153.3. Medical vendor reimbursements; allowable restrictions; peer-based
11 prescribing and dispensing practice patterns; Medicaid Pharmaceutical and
12 Therapeutics Committee

14 (D)(2)(a) Each nominating organization shall certify by affidavit that the
15 practice of each nominee involves either the care of or the supervision of the care of
16 Medicaid recipients. The committee shall be comprised of the following:

18 (xii) One physician or pharmacist from each Medicaid managed care
19 organization.
20 Section 2. R.S. 46:153.3(C)(1) is hereby repealed in its entirety.

1 Section 3. This Act shall become effective upon signature by the governor or, if not
2 signed by the governor, upon expiration of the time for bills to become law without signature
3 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
4 vetoed by the governor and subsequently approved by the legislature, this Act shall become
5 effective on the day following such approval.

Abstract: Provides relative to the change in Section title, the addition of a committee
position for the Medicaid Pharmaceutical and Therapeutics Committee, and the
revocation of certain allowable drug restrictions.
Present law provides that the present Section title includes peer-based prescribing and
dispensing practice patterns.
Proposed law removes peer-based prescribing and dispensing practice patterns.
Present law provides for the composure of the fifteen members appointed by the governor
to the Medicaid Pharmaceutical and Therapeutics Committee and the organizations from
which members are to be nominated from.
Proposed law adds one physician or pharmacist from each Medicaid managed care
organization to the committee.
Present law provides that the Louisiana Department of Health shall not restrict by prior
authorization any anti-retroviral prescription drugs prescribed and determined to be
medically necessary for the treatment and prevention of HIV/AIDS.
Proposed law repeals the present law which prohibits prior authorization drug restrictions
for any anti-retroviral prescription drugs prescribed and determined to be medically
necessary for the treatment and prevention of HIV/AIDS.
(Amends R.S. 46:153.3; Adds R.S. 46:153.3(D)(2)(a)(xii), and Repeals R.S. 46:153.3(C)(1))
