1 AN ACT
2 To enact R.S. 40:38.1 and 40(18), relative to vital record forms and fees for certified copies;
3 to provide for commemorative birth certificates; to distribute fees; and to provide for
4 related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 40:38.1 and 40(18) are hereby enacted to read as follows:
7 §38.1. Commemorative Birth Certificate
8 A. The department shall issue upon request and upon payment of an
9 additional fee as prescribed under R.S. 40:40(18) a commemorative birth certificate
10 representing that the birth of the person named thereon is recorded in the Vital
11 Records Registry. The state registrar may establish procedures for issuing
12 commemorative birth certificates; except that a commemorative birth certificate shall
13 be issued in a form consistent with the need to protect the integrity of vital records,
14 including secure measures designed to prevent tampering, counterfeiting, or
15 otherwise duplicating the birth certificate for fraudulent purposes pursuant to the
16 federal “Intelligence Reform and Terrorism Prevention Act of 2004”, 5 U.S.C. 301.
17 B. The commemorative birth certificate shall be suitable for display and may
18 bear the seal of the state and be signed by the governor.
19 C. A commemorative birth certificate shall have the same status as evidence
20 as that of a certified copy of a birth certificate.

1 §40. Fees for certified copies
2 Fees for filing, searching, and furnishing copies of vital records shall be
3 determined as follows:

5 (18) A fee of fifty dollars for a commemorative certificate of birth issued in
6 accordance with R.S. 40:38.1. Of this fifty dollars, twenty dollars shall be retained
7 by the state registrar to produce and administer commemorative certificates, and
8 thirty dollars shall be forwarded to the office on women’s health and community
9 health.
