WILDLIFE & FISHERIES: Permits the possession of certain wildlife
1 AN ACT
2 To enact R.S. 56:129, relative to possession of wildlife; to permit the possession of certain
3 native wildlife; to provide for restrictions; and to provide for related matters.
4 Be it enacted by the Legislature of Louisiana:
5 Section 1. R.S. 56:129 is hereby enacted to read as follows:
6 §129. Possession of native wildlife
7 Notwithstanding any other provision of law to the contrary, the following
8 native wildlife may be lawfully possessed:
9 (1) Native wildlife captured by hand from the wild in Louisiana may be kept
10 with the following restrictions:
11 (a) No more than six per household of any combination of the following
12 animals may be possessed:
13 (i) Hand-captured opossum, rabbit, raccoon, and squirrel.
14 (ii) Whitetail deer.
15 (iii) Hand-captured native nongame wildlife.
16 (b) It is unlawful to remove such wildlife or their offspring from Louisiana.
17 (c) The sale or transfer of such wildlife or their offspring is prohibited.
18 (2) All wildlife possessed in captivity shall be maintained in enclosures,
19 pens, or cages that are sufficiently strong to prevent escape of the wildlife and that
20 will simultaneously protect the wildlife from injury.

1 (3) All adult deer kept in compliance with this Section shall be confined in
2 an enclosure that complies with the following requirements:
3 (a) Enclosures shall have a perimeter fence that is not less than eight feet in
4 height and shall be constructed so as to prohibit the escape of confined cervids and
5 the ingress of native cervids.
6 (b) The area of the enclosure shall not be less than two hundred square feet
7 for the first cervid and shall be increased in size by one hundred fifty square feet for
8 each additional cervid.
9 (4) It is unlawful for anyone to keep a native wildlife animal under inhumane
10 or unhealthy conditions.
