WEAPONS/FIREARMS: Provides relative to the right to carry a firearm
1 AN ACT
2 To enact R.S. 14:95.11, relative to firearms; to provide relative to infringements on the right
3 to carry firearms; to prohibit the enforcement of laws that bar individuals from
4 lawfully carrying firearms; to provide for penalties; to provide for definitions; and
5 to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 14:95.11 is hereby enacted to read as follows:
8 §95.11. Firearm dispossession; prohibition; due process
9 A. Notwithstanding any provision of law to the contrary, no firearm shall be
10 confiscated, seized, taken, or transferred from a law-abiding citizen without due
11 process of law.
12 B. No governmental entity shall accept federal funding or grants for the
13 implementation, service, or enforcement of a federal statute, order, rule, or regulation
14 that purports to implement or enforce the seizure, taking, or transfer of a firearm
15 from a law-abiding citizen without due process of law.
16 C. Whoever violates the provisions of this Section shall be fined not more
17 than ten thousand dollars, imprisoned with or without hard labor for not more than
18 two years, or both.
19 D. For the purposes of this Section, the following terms have the following
20 meanings:

1 (1) "Due process" means the constitutional requirement that an individual
2 be provided notice, the opportunity to be heard, and a decision by a neutral
3 decision-maker when the government acts in such a manner that denies the
4 individual of life, liberty, or a property interest. The term also includes a
5 demonstration from the government that there is an articulated standard of conduct
6 for its actions with sufficient justification.
7 (2) "Firearm" means any pistol, revolver, rifle, shotgun, machine gun,
8 submachine gun, black powder weapon, or assault rifle which is designed to fire or
9 is capable of firing fixed cartridge ammunition or from which a shot or projectile is
10 discharged by an explosive.
11 (3) "Law-abiding citizen" means a person who is not prohibited from
12 possessing a firearm pursuant to R.S. 14:95.1, 18 U.S.C. 922(g), or any other state
13 or federal law.

Abstract: Prohibits infringements on a citizen's right to keep and bear arms.
Proposed law prohibits the confiscation, seizure, taking, or transfer of a firearm from a law-
abiding citizen without due process of law.
Proposed law prohibits a governmental entity from accepting federal funding or grants for
the implementation, service, or enforcement of a federal statute, order, rule, or regulation
that purports to implement or enforce the seizure, taking, or transfer of a firearm from a law-
abiding citizen without due process of law.
Proposed law provides for a penalty consisting of a fine of not more than $10,000,
imprisonment with or without hard labor for not more than two years, or both.
Proposed law defines the terms "due process", "firearm", and "law-abiding citizen".
