LIABILITY/CIVIL: Creates liability for recklessly throwing from a parade float
1 AN ACT
2 To enact R.S. 9:2796.1, relative to reckless throwing from a parade float; to create a
3 presumption of liability; to provide for exceptions; and to provide for related matters.
4 Be it enacted by the Legislature of Louisiana:
5 Section 1. R.S. 9:2796.1 is hereby enacted to read as follows:
6 §2796.1. Reckless throwing from parade float
7 A. No person shall knowingly or negligently throw an object from a parade
8 float in a manner that is foreseeable to cause injury to another person.
9 B. Whoever violates this Section and causes injury to another person shall
10 be presumed liable for such injury.
11 C. Nothing in this Section shall be construed to prohibit a specific item or
12 the handing, dropping, or responsible tossing of any item that is not otherwise
13 prohibited.
