CRIMINAL/SENTENCING: Provides relative to sentencing guidelines
1 AN ACT
2 To amend and reenact Code of Criminal Procedure Article 894.1(B)(33) and to enact Code
3 of Criminal Procedure Article 894.1(B)(34), relative to sentencing guidelines; to
4 provide an additional factor for the court to take into consideration when determining
5 a sentence of imprisonment; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. Code of Criminal Procedure Article 894.1(B)(33) is hereby amended and
8 reenacted and Code of Criminal Procedure Article 894.1(B)(34) is hereby enacted to read
9 as follows:
10 Art. 894.1. Sentencing guidelines; generally

12 B. The following grounds, while not controlling the discretion of the court,
13 shall be accorded weight in its determination of suspension of sentence or probation:

15 (33)(a) The defendant is a victim of domestic abuse, human trafficking,
16 trafficking of children, or sexual assault and there was a rational, causal, and
17 temporally proximate connection between the victimization of the defendant and the
18 instant offense.
19 (b) The court shall order a presentence investigation pursuant to Article 875
20 if a finding is made pursuant to this Subparagraph.

Abstract: Provides an additional factor for the court to take into consideration when
determining a sentence of imprisonment.
Present law provides for sentencing guidelines and provides for grounds that a court is to
consider in its determination of suspension of sentence or probation.
Proposed law retains present law and adds an additional factor for consideration when the
defendant is a victim of domestic abuse, human trafficking, trafficking of children, or sexual
assault and there was a rational, causal, and temporally proximate connection between the
victimization of the defendant and the instant offense.
Proposed law requires the court to order a presentence investigation pursuant to present law
(C.Cr.P. Art. 875) if a finding is made pursuant to proposed law.
