RETIREMENT/MUNICIPAL POL: Provides relative to earnable compensation for
employees in the Municipal Police Employees' Retirement System
1 AN ACT
2 To amend and reenact R.S. 11:2213(10), relative to the Municipal Police Employees'
3 Retirement System; to provide relative to earnable compensation; to provide for
4 definitions; to provide for applicability; to provide for effectiveness; and to provide
5 for related matters.
6 Notice of intention to introduce this Act has been published
7 as provided by Article X, Section 29(C) of the Constitution
8 of Louisiana.
9 Be it enacted by the Legislature of Louisiana:
10 Section 1. R.S. 11:2213(10) is hereby amended and reenacted to read as follows:
11 §2213. Definitions
12 The following words and phrases, as used in this Chapter, unless a different
13 meaning is plainly required by context, shall have the following meanings:

15 (10) "Earnable compensation" shall mean the full amount of compensation
16 earned by an employee for a given month, including supplemental pay paid by the
17 state of Louisiana, but shall not include overtime and shall not include any
18 nonrecurring lump-sum payment or ad hoc bonus, including but not limited to
19 recruitment incentives, hiring or signing bonuses, retention incentives or bonuses,

1 and any other one-time award not paid as part of the employee's regular recurring
2 salary.

4 Section 2. The provisions of this Act shall apply prospectively only to compensation
5 earned in pay periods ending on or after July 1, 2026.
6 Section 3. This Act shall become effective upon signature by the governor or, if not
7 signed by the governor, upon expiration of the time for bills to become law without signature
8 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
9 vetoed by the governor and subsequently approved by the legislature, this Act shall become
10 effective on the day following such approval.

Abstract: Provides relative to the definition of "earnable compensation" for members
within the Municipal Police Employees' Retirement System (MPERS).
Present law provides that a portion of an employee's "earnable compensation" is remitted to
MPERS for the purpose of providing retirement benefits.
Present law provides that the definition of "earnable compensation" is the full amount of
compensation earned by an employee within a given month, including state supplemental
pay.
Present law provides that overtime pay is not considered "earnable compensation".
Proposed law retains present law and provides that the following are also not considered
"earnable compensation":
(1) Any non-recurring lump-sum payment.
(2) Ad hoc bonuses.
(3) Recruitment incentives.
(4) Hiring or signing bonuses.
(5) Retention incentives or bonuses.
(6) Any other one-time award no paid as a part of the employee's regular recurring
salary.
