HOUSE CONCURRENT RESOLUTION NO. 47

A CONCURRENT RESOLUTION
To urge and request the Department of Children and Family Services, in consultation with
the state Department of Education, to study the implementation of the provisions of
Children's Code Article 603.1(B) relative to online training requirements pertaining
to reporting child abuse and to submit a report of findings and conclusions, including
any recommendations for related legislation, to the House Committee on Education
and the Senate Committee on Education no later than March 1, 2027.
WHEREAS, Children's Code Article 603 provides that the definition of "mandatory
reporter" includes a "teaching or child care provider", which is defined as any person who
provides or assists in the teaching, training, and supervision of a child, including any public
or private teacher, teacher's aide, instructional aide, school principal, school staff member,
bus driver, coach, professor, technical or vocational instructor, technical or vocational school
staff member, college or university administrator, college or university staff member, social
worker, an employee or an operator of an early learning center, an operator or employee of
a registered family child day care home, a licensed or unlicensed day care provider, or any
individual who provides these services to a child in a voluntary or professional capacity; and
WHEREAS, Children's Code Article 603.1(B) requires each teaching or child care
provider to complete an online training course provided by the Department of Children and
Family Services between June first and August thirty-first annually and requires that a record
of completion of the course by the teaching or child care provider be provided to each entity
at which he is employed; and
WHEREAS, Children's Code Article 603.1(B) further requires, no later than
September thirtieth of each year and in a manner prescribed by the state Department of
Education (DOE), each entity at which a teaching or child care provider is employed to
submit a list to DOE of all teaching and child care providers employed by the entity and
identify the employees that have complied with the training requirements and those
employees that have not complied; additionally, the law requires DOE to publish the
completion rates for each entity on its website; and

WHEREAS, concerns have been raised about the logistics of the implementation of
these requirements.
THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby
urge and request the Department of Children and Family Services, in consultation with the
state Department of Education, to study the implementation of the provisions of Children's
Code Article 603.1(B) relative to online training requirements pertaining to reporting child
abuse.
BE IT FURTHER RESOLVED that the study shall include the consideration of the
option of offering the training in person so that it can be completed by a group of individuals
assembling for the training and possibly streamlining the training so that it can be completed
in a shorter period of time.
BE IT FURTHER RESOLVED that the Department of Children and Family Services
shall consult with the state Department of Education which shall provide recommendations
concerning how to maximize the efficiency of the reporting requirements, including but not
limited to the feasibility of implementing a searchable database relative to training
completion.
BE IT FURTHER RESOLVED that the Department of Children and Family Services
shall include in its report an estimation of any costs associated with any recommended
changes.
BE IT FURTHER RESOLVED that the Department of Children and Family Services
shall submit a report of findings and conclusions, including any recommendations for related
legislation, to the House Committee on Education and the Senate Committee on Education
no later than March 1, 2027.
BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
secretary of the Department of Children and Family Services and the state superintendent
of education.
