DRUGS/CONTROLLED: Requests the Louisiana Dept. of Health to review the
implementation of existing law and guidance regarding pregnancy-related emergency
medications in hospital and acute care settings
1 A CONCURRENT RESOLUTION
2 To urge and request the Louisiana Department of Health to review and report on the
3 implementation of existing law and guidance regarding pregnancy-related emergency
4 medications in hospital, acute care, urgent care, and retail settings and to submit a
5 written report of its findings to the House and Senate committees on health and
6 welfare.
7 WHEREAS, the Legislature of Louisiana has enacted laws regulating certain
8 medications; and
9 WHEREAS, Act No. 246 of the 2024 Regular Session classified certain medications
10 as Schedule IV controlled substances under Louisiana law; and
11 WHEREAS, such classification carries specific storage, dispensing, and compliance
12 requirements for healthcare facilities; and
13 WHEREAS, pregnancy-related medical emergencies, including postpartum
14 hemorrhage and incomplete miscarriage, require timely medical treatment; and
15 WHEREAS, clarity and consistency in implementation of existing law are essential
16 to ensure that healthcare providers may act in good faith to protect patient safety while
17 remaining in compliance with Louisiana law.
18 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana hereby urges
19 and requests the Louisiana Department of Health, in consultation with the Louisiana Board
20 of Medical Examiners, the Louisiana Board of Pharmacy, the Louisiana Hospital

1 Association, and relevant professional medical associations, to conduct a review of the
2 implementation of existing law and guidance concerning pregnancy-related emergency
3 medications in hospital, acute care, urgent care, and retail settings.
4 BE IT FURTHER RESOLVED that the review shall include:
5 (1) A summary of current statewide implementation practices, including storage,
6 dispensing, and access protocols in emergency, inpatient, retail, and urgent care settings.
7 (2) Identification of any barriers to timely access in emergency or acute care or retail
8 or urgent care circumstances.
9 (3) An assessment of whether current implementation results in delay or uncertainty
10 for healthcare providers acting in good faith.
11 (4) A review of relevant peer-reviewed medical research, recognized clinical
12 guidance, and public health data.
13 (5) Consideration of stakeholder input from physicians, pharmacists, hospital
14 administrators, and patients or their advocates.
15 (6) The over or under prescription of the medications in certain geographic areas of
16 the state.
17 (7) The use of the medications before and after the passage of Act No. 246 of the
18 2024 Regular Session.
19 BE IT FURTHER RESOLVED that the Louisiana Department of Health shall
20 prepare a written report setting forth its findings specifically stating:
21 (1) Whether any rules, regulations, guidance documents, or compliance protocols
22 should be revised or clarified.
23 (2) The evidence and reasoning supporting any such recommendation.
24 (3) Whether recommended changes may be made administratively or would require
25 legislative action.
26 (4) If no changes are recommended, the basis for that determination.
27 BE IT FURTHER RESOLVED that the Louisiana Department of Health shall submit
28 its report to the House and Senate committees on health and welfare no later than February
29 1, 2027.

1 BE IT FURTHER RESOLVED that nothing in this Resolution be construed to amend
2 or alter substantive statutory law, but rather to ensure consistent implementation and patient
3 safety within the framework of existing law.
4 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
5 secretary of the Louisiana Department of Health.
