HOUSE RESOLUTION NO. 73
BY REPRESENTATIVE OWEN
A RESOLUTION
To authorize and direct the Louisiana State Law Institute to study the procedure of issuing
mandatory protective orders upon arrest for domestic abuse and to report its findings
to the House of Representatives of the Legislature of Louisiana no later than January
4, 2027.
WHEREAS, domestic violence abuse victims require the highest levels of
protections in order to empower them to make critical decisions to ensure their safety; and
WHEREAS, Colorado Criminal Code Section 18-1-1001 requires issuance of a
mandatory protective order against any person charged with domestic violence; and
WHEREAS, R.S. 46:2131 et seq., provides for the procedures for issuing temporary
restraining orders and protective orders when there is a threat or danger of violence or abuse
to a victim, and such order is requested by the victim; and
WHEREAS, the House of Representatives of the Legislature of Louisiana has
consistently prioritized the safety of domestic abuse survivors and recognizes that issuing
mandatory protective orders upon a charge of domestic violence may act as a critical
instrument in preventing further violence.
THEREFORE, BE IT RESOLVED that the House of Representatives of the
Legislature of Louisiana does hereby authorize and direct the Louisiana State Law Institute
to study the procedure of issuing mandatory protective orders upon arrest for domestic abuse
and to report its findings to the House of Representatives of the Legislature of Louisiana no
later than January 4, 2027.
BE IT FURTHER RESOLVED that the Louisiana State Law Institute shall submit
one printed copy and one electronic copy of any report produced pursuant to this Resolution
to the David R. Poynter Legislative Research Library as required by R.S. 24:772.
