DOMESTIC ABUSE: Directs the Louisiana State Law Institute to study mandatory
issuance of protective orders
1 A RESOLUTION
2 To authorize and direct the Louisiana State Law Institute to study the procedure of issuing
3 mandatory protective orders upon arrest for domestic abuse and to report its findings
4 to the House of Representatives of the Legislature of Louisiana no later than January
5 4, 2027.
6 WHEREAS, domestic violence abuse victims require the highest levels of
7 protections in order to empower them to make critical decisions to ensure their safety; and
8 WHEREAS, Colorado Criminal Code Section 18-1-1001 requires issuance of a
9 mandatory protective order against any person charged with domestic violence; and
10 WHEREAS, R.S. 46:2131 et seq., provides for the procedures for issuing temporary
11 restraining orders and protective orders when there is a threat or danger of violence or abuse
12 to a victim, and such order is requested by the victim; and
13 WHEREAS, the House of Representatives of the Legislature of Louisiana has
14 consistently prioritized the safety of domestic abuse survivors and recognizes that issuing
15 mandatory protective orders upon a charge of domestic violence may act as a critical
16 instrument in preventing further violence.
17 THEREFORE, BE IT RESOLVED that the House of Representatives of the
18 Legislature of Louisiana does hereby authorize and direct the Louisiana State Law Institute
19 to study the procedure of issuing mandatory protective orders upon arrest for domestic abuse
20 and to report its findings to the House of Representatives of the Legislature of Louisiana no
21 later than January 4, 2027.

1 BE IT FURTHER RESOLVED that the Louisiana State Law Institute shall submit
2 one printed copy and one electronic copy of any report produced pursuant to this Resolution
3 to the David R. Poynter Legislative Research Library as required by R.S. 24:772.
4 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
5 director of the Louisiana State Law Institute.
