1 AN ACT
2 To amend and reenact R.S. 11:1762(A) and to repeal Section 2 of Act 634 of the 2024
3 Regular Session of the Legislature, relative to retirees who return to part-time
4 employment in a position covered by the Municipal Employees' Retirement System;
5 to provide for retirement benefits under certain conditions; to provide for the
6 termination date of certain provisions; and to provide for related matters.
7 Notice of intention to introduce this Act has been published.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 11:1762(A) is hereby amended and reenacted to read as follows:
10 §1762. Part-time reemployment of retirees
11 A.(1) Whenever a retiree receiving normal retirement benefits becomes
12 reemployed by an employer but the retiree does not meet the definition of an
13 employee and either his monthly earnings are equal to or less than the difference
14 between his monthly average final compensation and his monthly retirement benefit
15 or the retiree has more than thirty years of creditable service and is at least age sixty,
16 his retirement benefits shall continue without any reduction, his retirement benefits
17 shall continue, and the retiree shall not be a member of the system.
18 (2) Whenever a retiree who has thirty years or less of creditable service and
19 who is receiving normal retirement benefits becomes reemployed by an employer but
20 the retiree does not meet the definition of an employee and his monthly earnings
21 exceed the difference between his monthly average final compensation and his
22 monthly retirement benefit, his retirement benefits shall be reduced by the amount
23 that his monthly earnings exceed the difference between his monthly average final
24 compensation and his monthly retirement benefit for every month of such
25 employment, and the retiree shall not be a member of the system. The calculation of
26 monthly earnings shall not include income attributable to service as a part-time
27 elected official listed in R.S. 11:164.

2 Section 2. Section 2 of Act 634 of the 2024 Regular Session of the Legislature is
3 hereby repealed.
4 Section 3. A retiree serving as a part-time reemployed retiree under the provisions
5 of Act 634 of the 2024 Regular Session of the Legislature before July 1, 2026, may continue
6 to serve as a part-time reemployed retiree without any reduction in his retirement benefits
7 so long as his part-time service remains continuous.
